  LEGISLATION
Fiji fishing vessel
defined as any fishing vessel which is registered in Fiji or whose operations are based in a place in Fiji, and which is wholly owned by a natural person who is a citizen of Fiji, or by a company which is at least 30% owned by Fiji citizens and incorporated in Fiji.
(Fisheries Regulations. as amended 1990 under the Fisheries Act 1978, Chapter 158 of the Laws of Fiji)

FIJI LEGISLATION
Licence conditions may include:
-determination of fishing area, periods and type and method of fishing;
-requirements concerning local landing and processing;
-acceptance of Fiji trainees on board;
-acceptance of Fiji observers on board;
-requirement that vessel carry specified identification marks and position-fixing equipment.

-Flag state to appoint fisheries representatives through whom all communications are to be made. (Reg. 4)
-These fisheries representatives must submit a fishing plan regarding proposed operations of vessels flying their countries' flag, including proposed fishing areas, estimated times of entry and departure from zone, duration of plan, probable ports of call, proposed transhipments, proposed landings of catch, proposed support operations. (Reg. 5)
-Minister may require proportion of catch be landed for processing at a port in Fiji. (Reg. 10(3))
-If there are changes in licence conditions, licence to be delivered for endorsement within 72 hours of vessel's entry into a Fiji port. (Reg. 12)
-Suspended or cancelled licences to be surrendered within 72 hours of receipt of notice. (Regs. 13 and 14)
-Licence to be produced on demand. (Reg. 15) licence to be maintained in good condition on board vessel. (Reg. 16)
-Compulsory port inspection upon entry into zone and prior to departure, unless exemption granted by Permanent Secretary. (Regs. 19 and 20)
-No vessel to be used for fishing before clearance to fish is given by Fisheries officer. (Reg. 19)
-Vessel to fly the flag of the country where registered. (Reg. 22)
-Vessel to display call sign, legible from sea and air, m specified form. (Reg. 23)
-Vessel to display lights and shapes required by International Regulations for Preventing Collisions at Sea. (Reg. 24)
-Vessel to carry English interpreter. (Reg. 26)
-Vessel to carry latest edition of International Code of Signals. (Reg. 27)
-Vessel to stow gear when in area not authorized for fishing (Reg. 30)
-Transhipment of catch at sea is prohibited unless authorized in advance. (Reg.31)
-Discharge of substances liable to cause harm to fish or marine mammals, to obstruct fishery equipment, or to create hazards to navigation are prohibited. (Reg. 32)
-Vessel to permit boarding by observers and enforcement officers and to put into port upon request for such purpose. Vessel to allow observers and fisheries officers full access to equipment, records and fish, and to allow observer to make tests, etc., in addition to providing assistance, food, and accommodations for said observers and officials. (Reg. 34)
-Vessel to comply with enforcement officers' instructions. (Reg. 36)

AGREEMENTS
Treaty on Fisheries between Governments of certain Pacific Island States and U.S.A., renewed on 15 June 1993 for 10 year extension, to be reviewed after 5 years.
-The operator and each member of the vessel's crew shall allow and assist an observer designated by the Pacific Island parties. (Annex 1, part 6)
-Application form contains: full name of vessel, vessel radio call sign, regional register number of vessel, full names and addresses of each person who is an operator, full name and address of insurer, whether owner or charterer is insolvent, and whether operator or vessel has been involved in a treaty violation. (Schedule 1)
-Internal waters, archipelagic waters and territorial seas of Fiji and Rotuma and its Dependencies are closed areas.

LEGISLATION
Licence conditions may require reporting of catch and effort, as well as vessel position reports.
(Marine Spaces Act. 1977, sect. 12)
-Notification of proposed entry into zone must be given to Permanent Secretary at least 24 hours in advance. (Reg. 18)
-Notification to include description of vessel, including vessel name, call sign and country of registration, location of entry, port to which vessel will proceed for inspection, fish on board (species, quantity and condition). (Reg. 18)
-Permanent Secretary must be notified on proposed port calls at least 24 hours in advance. (Reg. 21)
-Vessel to maintain ship's log and separate fishing log in English in form provided or approved by Permanent Secretary, with daily entries of effort, fishing method and areas, catch (Reg. 25)
Fishing log to be forwarded to Permanent Secretary within 72 hours of arrival in Fiji port. (Reg. 25)
-Vessel to make daily reports to Permanent Secretary regarding details of vessel and position. (Reg. 28)
-Vessel to make weekly reports of quantity of each species of fish taken during previous week and area where caught. (Reg. 28)
-National fisheries representative to give notification of filling of quota. (Reg. 29)
