MYANMAR LEGISLATION
After obtaining licence and registering, payments must be made in foreign currency for licence fee
(including fee for granting a fishery to foreign vessel and tender fee in the event that tenders are floated for allotted fishing areas), fresh fish duty, security deposit, registration fee, late fee, etc.

LEGISLATION
Department determines fishing grounds in territorial waters beyond the baselines and grants rights in the following order:
-Agreement between State Economic Organization and foreigner;
-Agreement between citizen (includes an associate citizen, a naturalized citizen, an economic organization formed with local investment only, and Cooperative Societies formed under Cooperative Societies Law, s. 2 and foreigner. (Sect. 14)

LEGISLATION
-Department determines fishing grounds beyond the baselines and grants rights to the following: foreign vessels which have registered in the country;
-foreigner with hired local fishing vessel;
-joint venture fishing with by foreigner using a fishing vessel registered in the country.

MYANMAR
LEGISLATION
Master of fishing vessel shall:
- abide by terms and conditions of licence;
- display licence and registration certificate at wheelhouse of vessel;
- proceed directly to port of place of inspection upon entry into fisheries waters;
- fly Myanmar flag and flag of country in which vessel is registered, when in fisheries waters;
- proceed to port or place specified for inspection upon leaving fisheries waters;
- take responsibility for safety of inspectors, researchers, observers, and trainees on board. (Sect. VI) -Owner shall:
- pay prescribed fees in foreign currency;
- comply with regulations, by-laws and instructions of Department;
- provide necessary services free of charge to researchers, observers, and trainees;
- abide by laws of Myanmar;
- appoint agent capable of taking charge of fishing operations;
- have right to apply for special permission to fish determined species in other Myanmar fisheries waters;
- have the right to apply for permission to purchase Myanmar gear and other items;
- have the right to apply for permission to load, unload, process, and transfer fish;
- have the right to repair vessel at any internal port;
- have the right to appeal to Minister against decision of Director General. (Sect. III)
-When a licence-holder transfers licence to any other person, the Director General may forfeit the security deposit, revoke the licence, enter licence-holder's name on "black list". (Sect. IV(19))

AGREEMENTS
Joint Venture between the Myanmar Department of Fisheries and Thailand's ONK Mining and Construction Co. Ltd. to catch and process fish in Myanmar
The Thai company was granted a 20 year concession to fish in Myanmar EEZ

LEGISLATION
-Master of fishing vessel shall maintain ship's logbook and fishing logbook.
-Master shall report to Department, within specified time, all particulars relating to vessel, route of entry, arrival time and day, goods and commodities, fishing gear, and list of persons on board.
