APPENDIX 2

DUTIES AND FUNCTIONS OF THE KENYAN NATIONAL ENVIRONMENT SECRETARIAT
(KENYA, NATIONAL ENVIRONMENT SECRETARIAT, 1979)

In broad terms, the Secretariat's duties and functions include:

  1. formulation of national policies calculated to conserve or enhance the environment;

  2. determination of environmental criteria in the appraisal of environmental impacts of development projects and other human activities;

  3. identification of sound options by evaluating the practical application of research findings against socio-economic and cultural needs or other constraints;

  4. collation and interpretation of all environmental data for use by relevant government departments and other institutions;

  5. investigation of ecosystem management, adequacy of natural resources for meeting national requirements in the light of population pressures, human settlements and analyses of environmental quality in order to assess current or prospective environmental trends as related to the overall national interest;

  6. coordination of environmental research and other related activities;

  7. initiation or support of needed legislation and preparation of regulations on specific matters related to the environment; and

  8. promotion of environmental education through initiation of related training programmes and programmes for public information.

Since its establishment, it has embarked on:

  1. developing procedures for collaborating with other government institutions to ensure that environmental criteria are fully weighed within the processes of decision making;

  2. developing systematic, inter-disciplinary approach which will ensure the integrated use of the natural and social sciences in planning and decision-making on environmental matters; and

  3. seeking available solutions in cases where conflicts arise with regard to the alternative utilization of the environmental resources.

APPENDIX 3

BASIS FOR EFFLUENT STANDARDS AND CHARGES IN MALAWI IN MAY 1979

In Regulation 12, sub-regulation (1) of the Water Resources (water Pollution Control) Regulations, 1978, it is stated that a person to whom the Minister's Consent has been granted shall pay such fees and rents and in such manner as the Minister may specify in the Consent. The application fee is now K.10.00 for every application. The annual rents will be the product of four factors, and also be a function of a unit rate prescribed by the Minister. The present recommended unit rate is k.1.00.

The factors considered in the rents are:
