COLOMBIA LEGISLATION
Fishing fees and rights are determined by INPA which shall consider: (1) fishing category; (2) catch evaluation by species; (3) fishing quota against resource available; (4) type of vessel,
GRT; (5) catch destination; and (6) management costs of the activity. (Art. 48)

-Sport fishing fee for non-resident foreigners: 30 SMLD for maritime fisheries.
-Foreign licence fee for fishing of: crawfish, shrimp and sea shell fishing = 5 SMLD/GRT; white tuna and other species = 4 SMLD/GRT.
-Fee for industrial commercial fishing by foreign or mixed fishing fleet: 75 SMLD for the 1st vessel, and 25 SMLD for additional foreign vessel or 15 SMLD for additional Colombian vessel.
Note: SMLD = Legal Minimum Salary per Day in Colombia.

LEGISLATION
Industrial commercial fishing undertaken by foreign vessels shall operate through affiliation or chartering agreement with Colombian firm holding a fishing permit. (Art. 28)

Joint-venture fishing activities set up by commercial contracts subject to the following conditions:
-determined objects of association;
-fees payable equivalent to licence fee, in exceptional cases compensation accepted with training, transfer of technology, fisheries infrastructure, or supplying of local market;
-period of validity of contract depends on its finality and not to exceed 5 years;
-local representative or permanent resident to be designated foreign party;
-guarantees to be provided under conditions of INPA and can be set in kind. (Art. 105)
-Minimum 20% of the crew on foreign fishing vessels shall have Colombian nationality. (Art. 153)

COLOMBIA LEGISLATION
-Fishing rights granted to foreign natural or legal persons, through commercial contracts with INPA, for carrying out of fishery joint venture activities. (Art.47)
-Tuna and tuna species fishing undertaken by foreign vessels shall operate through partnership with INPA, or through-affiliation or chartering agreement with a Colombian firm, in compliance with present legislation. (Art. 31)

-Foreign natural person applying for fishing permit, shall be resident in Colombia, except for research and sport fishing.
-Foreign legal person applying for research or sport fishing permit, shall empower a local representative and identify crew members. 53)
-Fishing permit is untransferable and shall include holder identification, fishing areas, quota by period, catch percentage for local market, fishing methods, fees applicable, other. (Art. 57)
-Industrial commercial fishing shall be permitted to foreign vessels under contract with Colombian fishery firm which supplies national market with a INPA-set-percentage of its production; fishing products to be landed in Colombian ports. (Art. 67)
-Licence application for industrial commercial and research fishing to be accompanied with plan of activities in form and terms prescribed by INPA. (Arts. 68 and 77)
-Validity of licence up to 5 years. (Arts. 69 and 77)

LEGISLATION
INPA is competent for collecting, analyzing and spreading of statistical data on fisheries. (Art. 58)
