GHANA LEGISLATION
-Foreign participation in fishing is restricted to tuna fisheries.
-Fees for tuna vessels under joint venture registered in Ghana depend on GRT of vessel, according to following system:
151-200 tons = 23,200 p.a.;201-300 tons = 50,000 p.a.; 301-400 tons = 75,000 p.a.; 401-500 tons = 100 000 p.a.; 501-800 tons = 150 000 p.a.; 801 and above = 200 000 p.a.
-Fee for chartered tuna vessels = US$ 175/ GRT/ year.
-Fee for foreign tuna vessels or carriers used for transhipment = US$ 500 per call.
-Fee for longliner tuna vessels which call at Ghanaian port not more than twice a year = US$ 3,000 per call.

LEGISLATION
Foreign tuna companies allowed to enter into partnership with Ghanaian companies where at least 25% of shares in the joint venture for tuna fishing are owned by the Government under the Ghanaian Companies Code 1963 (Act 179), by a citizen of Ghana, a public company, or by a limited liability company registered in Ghana, with its principal place of business in Ghana and its shares owned wholly by the Government, a citizen of Ghana, a public corporation, or an association of these.

LEGISLATION
Foreign vessel
defined as a motor fishing vessel which is wholly owned by persons other than Ghanaians or in which the substancial interest is owned by persons other than Ghanaians. (Art. 45)

GHANA LEGISLATION
-Fishing by foreign vessels prohibited except for tuna fishing. Licences may be issued for tuna vessels where vessel is:
(a) at least 25% locally owned; or
(b) owned by company that is at least 25% share-owned by Ghanaian nationals; or
(c) under charter agreement with local person or company that confers option to purchase within 3 years for which adequate provisions are made for training, transfer of skills and expertise, as well as adequate arrangements for supply of ice that will not prejudice supply to local fleets. (Sect. 6)
-Except where permitted by regulations, all catch and fishloads of licensed tuna vessels must be landed in Ghana before any transhipment or export thereof. (Sect. 33(1))
-No black skipjack tuna and no fish other than tuna to be transhipped or exported. (Sect. 33(2))
-Permission to export required for all species of tuna from licensed vessels.
-At least 10% of designated species of tuna landed in Ghana to be offered for sale to local canneries (skipjack, yellow fin, big, albacore). (Sect. 33(4))
-Vessels to observe requirements concerning identification markings. (Sects. 24 and 26)

LEGISLATION
Written returns to be submitted regarding operations of the vessel, as required by the licensing officer.

* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
