INDONESIA LEGISLATION
Fees for joint venture vessels range from US$500 to US$1 000 per vessel, plus royalties on exported fish:
-shrimp = 2% of FOB price
-tuna= 1.5% of FOB price
-skipjack = 1.5% of FOB price
-pearl = 1.5% of FOB price
-other species = 1 % of FOB price

Registration (fishing permit) fee = US$ 3 per GRT
Fee for changes to permit = US$ 100
Royalties on catches:
-longliners = US$ 86 per cubic meter (M3)
-pole and line vessels = US$ 102 per cubic meter
-purse seiners = US$ 107 per cubic meter
-fishnetters = US$ 207 per cubic meter
-gillnetters and others = US$ 55 per cubic meter

Royalties on catches by fish net = US$ 145 per cubic meter.

LEGISLATION
Guidelines for joint ventures specify:
-undertakings not to compete with small-scale or traditional artisanal fisheries;
-investor to be bona fide company;
-investment to lead to foreign exchange earnings;
-share ratio for Indonesian partner to start at 20%, rising to at least 40% within 5 years and to 51% within 10 years.

AGREEMENTS
Joint venture formed between Philippine commercial deep sea fishing company and an Indonesian fish trader for commercial deep sea fishing operations in Arafura and Rarda Seas in East Indonesia among other activities.

INDONESIA LEGISLATION
Licence conditions may include:
-name and nationality of owner or company;
-name, registration number, call sign, flag, overall length, gross tonnage, horsepower rating, fish hold capacity;
-name, address, nationality and certificate of master,
-number of crew, type and amount of fishing gear, fishing ground, identification of vessel, port of reporting, and validity of permit.

-Permit valid for one year, non-transferable, must be kept on board vessel.

-Vessel must have identification card (Decree No. 475, art. 8), sailing permit and security clearance to cross EEZ.

-Vessel must have Indonesian agent. (Government Regulations. No. 15 of 1984. art. 15: Decree No. 475, art. 7)
-Vessel must accommodate inspectors, provide allowance, and leave them in a port. (Decree No. 476, art. 2(e). (2))
-Vessel may only carry gear specified in permit and must stow gear while transiting. (Decree No. 475, conditions art. 2(e))
-Vessel may be required to call in port before, during and after fishing.

-Fishing by foreign vessels prohibited except under signed contract or Agreement.
-Licences also include requirements concerning refrigeration equipment and handling of fish, species size limitation (Decree No. 123 of 1975), and mesh size (Decree No. 607 of 1976)
-Fishing zones specified:
-Fishing Zone I (0-3 n.m. from baseline) - closed to fishing vessels over 5 GT;
-Fishing Zone II (3-7 n.m. from baseline) - closed to fishing vessels over 25 GT;
-Fishing Zone III (7-12 n.m. from baseline) - closed to fishing vessels over 100 GT.

LEGISLATION
Vessel must report to designated officials before, during and after fishing.
(Government Regulations No. 15 of 1984, art. 14(1); Decree No. 475, art. 9)
Vessel must report at least 24 hours prior to entering EEZ, position at least every 24 hours and position and catch data at least 72 hours before leaving EEZ.
(Decree No. 475, conditions (f), (i2) Reporting), (j); Decree No. 476, art. 2) Reporting may be done via electronic communication network system for vessels entering into or departing from fishing grounds outside Indonesian territorial sea. (Decree No. 2771 of 1987, art. 11(3))

AGREEMENTS
Fisheries Agreement between Indonesia and Chile of 1995
Chilean vessels allowed to operate in Indonesian EEZ, and establishment of joint ventures encouraged.

% = Reports must be made every 3 days for vessels from Norway, Sweden and Faroes when fishing for herring, weekly when fishing for other species .

* = Country is a part to the South Pacific FFA arrangement which stipulates that licences will not be issued to foreign fishing vessels unless those vessels are listed in good standing on the FFA - maintained regional register of fishing vessels .
