LEGISLATION
The President may enter, on appropriate conditions, into an agreement with a foreign State or an international representing a community of States, whereby provision is made for the operation in Namibian waters of fishing vessels registered in such foreign State or community. (Art. 27(1))

LEGISLATION
Foreign Vessel defined as a vessel: (a) registered in any foreign country under the relative laws in force in that country or recognized as a vessel of a foreign country; or (b) not being registered or licensed or required to be registered or licensed in Namibia in terms of the Merchant Shipping Act No. 57 of 1951.

NAMIBIA LEGISLATION
-Foreign vessels under applicable fisheries agreement shall obtain a permit for fishing within Namibian waters from the Minister. (Art. 27(2)) -Fishing permit shall be valid for the period mentioned therein and shall include the following obligations:
- display of registration number allocated to the vessel;
- related to the use of the landing, storing or handling or any other facilities in a particular harbour;
- specification of area within, and period during which fishing by or from vessel is authorized;
- determine of type of fishing gear which may or not be used on board or may not be carried on board of such vessel;
- related authorized or prohibited methods of fishing;
- specification of authorized or prohibited fishing species;
- definition of maximum allowable catch during specified period:
- specification of prohibited fishing species and minimum size of fishing species;
- prohibition of discard, landing or disposal of fish caught;
- quota limits for by-catch;
- terms and conditions for transhipment;
- inspection of the vessel whether at sea or in harbour,
- boarding conditions of inspectors and observers designated by the Minister;
- regarding conduct of fisheries research and disclosure of related information and any other matter deemed necessary by the Minister. (Arts. 27(3) and 26(5)(b))
-Unauthorized fishing vessel may stow gear.

Further regulations may be introduced by the minister on reporting requirements, appointment of representative with respect to foreign licensed vessels and other matters. (Art. 32)
