LEGISLATION

LEGISLATION
Local fishing vessel
defined as any fishing vessel (a) wholly owned by any company, society or other association of persons established under the law of Somali Democratic Republic (SDR) or registered in Somalia under the Law of SDR; (b) wholly owned by one or more persons who are citizens of Somalia; (c) wholly owned by a statutory corporation established under the laws of SDR or by the Government of SDR.

SOMALIA LEGISLATION
-Conditions for joint venture licence:
-Vessels 18 m. or more in length may not fish within 5 miles of shore. (Sect. 7)
-Catch must be landed in Somalia or inspected prior to export. (Sect. 9)
-Licence may be subject to conditions concerning area, period, type of fishing, nature of catch, reporting, marking, inspection, training. (Sect. 10)
-Proof required of foreign partner's financial and technical capacity and bank guarantee to cover share of investment. (Sect. 11)
-Licence valid for one year, non-transferable, must be kept on board vessel. (Sects. 17-18)
-Observers may be designated at expense of joint venture. (Sect. 19)

LEGISLATION
Joint venture licence:
-Statistical information (catch and effort) must be reported.
-Reports on vessel position and on fishing conditions.
-Daily reports by radio of position, catch by species, and monthly written reports.
