CHAIRMAN: I declare the Twenty-Second Plenary Meeting open. The first item on our agenda is the adoption of the Eighth Report of the General Committee. I will ask the Secretary-General to read it section by section.

LE SECRETAIRE GENERAL: Premièrement, le règlement des arriérés de contributionsdu Congo et de la Mauritanie. Les versements effectués récemment par la République populaire du Congo étant supérieurs au montant requis aux termes du paragraphe 4 de l'Article III de l'Acte constitutif concernant le droit de vote, et eu égard à la demande faite par le gouvernement, le Bureau attire l'attention de la Conférence sur le fait que le projet de résolution figurant à son troisième rapport, le document C 77/LIM/30 n'est plus nécessaire, et recommande en conséquence que cette question ne figure plus au rapport de la Conférence.

CHAIRMAN: Are there any comments on this proposal, the withdrawal of the resolution on the Congo? If there are no comments, then it is adopted.

LE SECRETAIRE GENERAL: Le Bureau par ailleurs a été également informé que la République islamique de Mauritanie avait effectué un versement supérieur au montant requis aux termes du paragraphe 4 de l'Article III de l'Acte constitutif et avait donc régularisé sa situation.

Le bureau a pris note que le Président de la Commission de vérification des pouvoirs avait bien reçu les pouvoirs de l'Observateur d'une autre Organisation non gouvernementale jouissant du statut consultatif auprès de la FAO et qui figure au document C 77/LIM/43-Sup. 1.

LE SECRETAIRE GENERAL: Il reste encore une dernière section qui concerne les élections des membres du Conseil, à laquelle nous allons procéder maintenant.

Le bureau a pris note du retrait de la candidature de la République arabe syrienne à un siège au Conseil, en faveur du Liban, pour la période novembre 1977-novembre 1979. Ceci figure au document C 77/LIM/45-Sup. 1.

Enfin, afin de ne pas interrompre la procédure de vote pendant les élections des membres du Conseil, le bureau recommande à la Conférence qu'il ne soit donné la parole à une délégation désirant recourir à une déclaration de vote sur l'une quelconque des périodes, qu'une fois clos l'ensemble des tours de scrutin et les élections terminées.

LE SECRETAIRE GENERAL: Le Journal de la Conférence d'aujourd'hui comprend en première page un modèle de bulletin de vote pour l'élection des membres du Conseil, avec naturellement des pays fictifs, mais qui indique la manièredont les bulletins qui sont distribués au moment du vote doivent être remplis.

Comme l'a décidé la Conférence en adoptant le septième rapport de son bureau, qui figure au document C 77/LIM/45 et son supplément, la première étape des votes comprendra les scrutins concernant les régions dotées de sièges supplémentaires pour les deux premières périodes, à savoir novembre 1977-31 décembre 1978, et novembre 1977-novembre 1979. Il s'agit de l'Afrique, de l'Asie-Extrême-Orient, et le Proche-Orient. Les trois autres régions, à savoir l'Europe, l'Amérique latine, l'Amérique du Nord et le Pacifique Sud-Ouest, n'ont pas de sièges vacants pour ces périodes. Il n'y a qu'une seule région, Asie-Extrême-Orient, pour laquelle deux candidats se présentent à un seul siège pour la période novembre 1977-31 décembre 1978. Dans les trois autres cas, le nombre des candidats est égal à celui des sièges à pourvoir.

Aux termes de l'article 12, paragraphe 9a, du Règlement général de l'Organisation, l'élection des membres du Conseil a lieu au scrutin secret. Cette disposition est applicable même lorsque le nombre de candidats est égal à celui des sièges à pourvoir. Il est donc nécessaire de procéder également à un scrutin secret dans ces dernier cas.

Chaque bulletin de vote doit être rempli conformément aux instructions qui y figurent.

Il ne faut pas oublier que le nombre de sièges vacants varie de région à région. Dans les cas où il y a plus de candidats que de sièges à pourvoir, il faut marquer une croix dans le cadre figurant au regard du nom de chacun des pays que l'on désire élire aux sièges vacants, ainsi qu'il apparaît dans le bulletin modèle donné dans le journal.

Il importe de rappeler qu'aux termes de l'article 12, paragraphe 11 (a) du Règlement général, chaque électeur, à moins qu'il ne s'abstienne de prendre part au scrutin, exprime son suffrage pour chacun des postes électifs à pourvoir en désignant un candidat différent pour chaque poste.

Tout bulletin qui ne remplit pas ces conditions est nul.

Aux termes de l'article 12, paragraphe 4 (c) du Règlement général, est enregistré comme une abstention tout bulletin blanc.

Aux termes du paragraphe 4 (d) dudit article 12, les bulletins de vote ne doivent porter aucune indication ni aucun signe autres que ceux par lesquels s'exprime le suffrage.

Tout bulletin de vote portant des suffrages pour un nombre de pays supérieur au nombre de sièges à •pourvoir est nul.

Est également nul tout bulletin de vote portant des suffrages pour un nombre de pays inférieur au nombre de sièges à pourvoir.

Pour être valide, un bulletin de vote doit donc porter un nombre de croix égal au nombre de postes vacants.

Le premier scrutin, qui se réfère à la première étape du document C 77/LIM/45, paragraphe 8, sera suivi de tout scrutin supplémentaire qui pourra être nécessaire en liaison avec les périodes mentionnées dans


cette étape. Il sera ensuite procédé au scrutin concernant les régions qui ont des sièges à pourvoir pour la troisième période, c'est-à-dire novembre 1977-novembre 1980, et ce scrutin sera, à son tour, suivi, le cas échéant, de scrutins supplémentaires, toujours pour cette deuxième étape. Ensuite auront lieu les scrutins concernant les régions qui ont des sièges à pourvoir pour la quatrième période, la troisième étape du document C 77/LIM/45, c'est-à-dire la période janvier 1979-novembre 1981, et le cas échéant, des scrutins supplémentaires pour cette période.

CHAIRMAN: Thank you, Mr. Secretary-General.

I would like to draw the attention of the delegates to paragraph 14 of Rule XII of the General Rules of the Organization, which specifies that once voting has commenced, no delegate or representative may interrupt the voting except to raise a Point of Order in connexion with the voting.

I should like to suggest that we appoint four tellers instead of two so that the counting of votes can proceed more rapidly. I am told there are 113 countries present in the Hall. I call upon the following delegations: Norway, Panama, Papua and New Guinea and Sierra Leone to act as tellers for these elections. Would they please proceed to the voting area.

If there are no comments, I will ask the Assistant Secretary-General to call the Member Nations to proceed to the voting area.

CHAIRMAN: May I again stress that all Reports of all three Commissions have been adopted in the Commissions which are bodies of the whole. Their substance and form has been extensively discussed there, and we are not expected to re-open the discussion on them here.

I shall therefore proceed section by section for the formal adoption of these documents, and will ask you to please refrain from raising matters of substance. If there is disagreement on any point, we shall simply have to vote by a show of hands. Those countries who object to one or another part of our Report may have their reservations recorded in the Verbatim Records, and if they so insist, even in the Report.

Any drafting amendments of a corrective nature should be handed directly to the Secretary-General, and I will examine them with him on the understanding only amendments of pure form can be retained. I trust that after your lengthy debates in the Commissions we will not have to vote unnecessarily.

CHAIRMAN: There is a mistake in the last sentence of paragraph 3 of document C 77/REP/8. The word "would" should be replaced by "could"

In paragraph 4, page 2, second sentence, the word ''updating" should be inserted after the word "providing training, ".

In paragraph 4, on page 3, the word "and" should be inserted between the word "natural resources" and "that assistance. . . ".

B. de AZEVEDO BRITO (Brazil): I wonder in the last sentence of paragraph 4 if it is not more appropriate to say "when it is foreseen that it will have beneficial repercussions". I think that is the real meaning.

J. R. PEREZ FERNANDES (Cuba): Es en relación con la última oración del punto 4 que aparece tal y como fue acordado por todas las delegaciones ayer. Lo único es que le han agregado, a nuestro juicio innecesariamente, la palabra "probablemente", que nuestra delegación plantea que se suprima, porque ninguna delegación, ni la Mesa, mencionó ayer añadirla al párrafo propuesto.

Así que planteamos concretamente suprimir la palabra "probablemente" de esa oración.

B. de AZEVEDO BRITO (Brazil): My amendment is precisely the same as Cuba in Spanish, the effect is precisely the same, to take out "likely" and "probablemente" in Spanish. "Foreseen" that is already an indication on estimation so "likely" is unnecessary. It is precisely the same amendment as that of Cuba.

CHAIRMAN: Paragraph 7 on page 4, there is some small mistake, the fifth line "within the area of jurisdiction of any state without the state's express request as has so far been the practice of FAO. ", not "as has as".


A. DEUSTUA (Peru): Mi intervención era respecto al párrafo 4. El pulsante parece que no funciona y por eso no fui visto por la Mesa.

Tenemos que hacer alguna observación a la ultima oración del párrafo 4. Mi delegación no tiene ningún inconveniente en la sugestión formulada por la delegación de Cuba, pero el interés nuestro es que parece ser que con la discusión habida al respecto de esta última frase en la Comisión, pasó sin tomarse debida nota una precisión que mi delegación formuló en la Comisión. Voy a leer el texto tal como está en mi versión española. Dice: "Recordó que la asistencia sólo puede concederse previa solicitud, en la forma indicada por los países interesados, y teniendo en cuenta los derechos soberanos de los estados ribereños., etc. ". Lo que creo que se acordó en la Comisión es que era "en la forma indicada por los países ribereños interesados". Hay que agregar la palabra "ribereños" y seguiría ". . . y teniendo en cuenta los derechos soberanos de los estados ribereños. . . ". Eso es todo.

CHAIRMAN: There is no objection to the proposal made by the delegate of Peru.

PEREZ FERNANDEZ (Cuba): En el penúltimo párrafo del punto 7 que dice: "varias delegaciones recomendaron a la FAO que estimulara a los países en desarrollo a participar, etc., etc. "; en el texto español se escribió la palabra "estimulara" y la palabra acordada ayer fue "propiciar", que tiene un significado diferente a estimular, ya que la palabra propiciar incluye el estímulo y otra serie de acciones; por lo tanto entendemos importante que se escriba "propiciar", tal y como se acordó ayer por todos los países que discutimos el texto.

SECRETARY-GENERAL: This affects only the English text. A sentence was dropped out at the end of paragraph 2 and a corrigendum is being issued and is in circulation, REP. 9-Cor. 1. I will read out this sentence which was dropped out in the typing, so at the end of paragraph 2 of REP. 9, "In particular the delegations of Cuba and Algeria expressed the view that Article 9 should provide for the resolution of disputes through diplomatic channels between the parties concerned, and that Article XI reflected aspects of a colonial situation which might be contrary to Resolution 1514(XV) of the United Nations General Assembly".

B. E. MATAMOROS HUECK (Nicaragua): Para una corrección muy breve. En la segunda oración se dice "algunas delegaciones expresaron su preferencia por el mantenimiento del modelo de certificado fito-sanitario en su forma actual". Durante el curso de este debate muchas delegaciones expresaron su preferencia para que el modelo del certificado se mantuviera; por lo tanto nosotros solicitamos que al inicio de esa oración en vez de decir "Algunas delegaciones", se diga "Muchas delegaciones", en inglés ''many delegations''.


Ε. DIAZ BUSTABAD (Cuba): Solamente para recalcar que lo que expreso nuestra delegación y que no se ha recogido textualmente, al final del párrafo que se ha añadido al inglés, dice "pudieran ser contrarios a la resolución 1514" y lo que expresó nuestra delegación, y fue apoyado, es que "son contrarios".

A, LOCHEN (Norway): My delegation cannot agree with the amendment proposed by Nicaragua that "some" should be changed to "many". I think it was only very few who expressed their preference for maintaining the Model Phytosanitary Certificate. I think the report should reflect what actually took place in the Commission, so I urge that we maintain "some".

J. S. CÁMARA (Guinée): Je voudrais dire que je ne suis pas d'accord avec ce qu'a dit l'orateur précédent, le délégué de la Norvège. Le délégué du Nicaragua a parfaitement raison. Lorsqu'il s'est agi de voter, un vote massif s'est prononcé en faveur des thèses défendues par la délégation du Nicaragua. Il faudrait donc dire "de nombreuses délégations" et non pas "certaines délégations".

CHAIRMAN: May I first go back to the proposal made by Cuba. Instead of "might be" it should be "are". If there is no objection we will change the words "might be" to "are".

A. LOCHEN (Norway): When Commission III voted, it was only on the question of whether adoption of the new text should be postponed or not and not on the question of whether the Model Phytosanitary Certificate should be maintained, only on the question of postponement. I am sure that the Secretariat can confirm this, and I would like to have this confirmed.

LEGAL COUNSEL: What Norway has just said is correct, and it is reflected in the first sentence of paragraph 4 of the report before you.

A. A. W. LANDYMORE (United Kingdom): I pressed my button when you raised the matter of approval of the Cuban amendment. I just have one small point, and that is the wording must remain in reported speech so that we continue to read the speech of the views of Cuba and Algeria, and to convey that in English, you cannot say "are", you must say "were".

CHAIRMAN: I would like to elaborate that in paragraph 2, according to the Secretariat, the words "some delegations" have been confirmed and not "many".

B. deAZEVEDO BRITO (Brazil): There is a small point which was perhaps omitted by mistake. In paragraph 2 perhaps we should say something regarding the position of some delegations on the question of new obligations, yes or no. I would suggest that to take care of this point we add after the first sentence on the following lines. The exact text can be adjusted, the English can be amended. "Some delegations considered that the proposed amendments constituted new obligations to the fact of Article XIII of the Convention". That could come just after the first sentence of paragraph 2.

SECRETARY-GENERAL: The Legal Counsel has proposed a slightly different wording which may find the approval of Brazil. This would be a new sentence which would come as the second sentence of paragraph 2. "Some delegations considered that the proposed amendments involved new obligations within the meaning of Article XIII of the Convention".

B. E. MATAMOROS HUECK (Nicaragua): Mi delegación está de acuerdo con la enmienda presentada por Brasil, pero me parece que quizá podríamos agregar a esta enmienda, "y otras disposiciones relativas a los


artículos del convenio", porque no creo que sea necesario en este momento puntualizar cuáles eran esos otros artículos; varias delegaciones se refirieron a la necesidad de aclarar otras disposiciones vigentes en los otros artículos del convenio. Yo creo que es necesario incorporar también estos conceptos.

LEGAL COUNSEL: The question of new obligations arises only in connection with specific amendments that have been proposed to the Conference. Now, the question of other amendments that some countries may find desirable is covered, I believe, in the penultimate sentence, of paragraph 2, where it is stated that "A few delegations felt that other provisions, for which no amendments had been proposed, should also be re-examined. " I think therefore that to speak of new obligations as long as no amendments have been proposed might not be quite correct.

M. A. BENDJENNA (Algérie): Il s'agit du paragraphe 4. Ma délégation avait proposé à la Commission III un amendement à ce paragraphe et elle voudrait justement, pour mieux préciser de quel type de disposition auquel elle a voulu se référer, proposer d'ajouter à la septième ligne du paragraphe 4, après les mots: "de caractère purement juridique" ce qui suit: "allant à l'encontre de l'évolution du droit international.

LE CONSEILLER JURIDIQUE: Je crois qu'il faut tenir compte du fait que ce membre de phrase commence par: "le Directeur général transmettra à toutes les parties de la Convention et aux autres Etats Membres de la FAO un document, etc. . qui fera ressortir les principales vues formulées à cette session, y compris des dispositions de caractère purement juridique".

Le délégué de l'Algérie propose, si j'ai bien compris, d'insérer à ce point "allant à l'encontre de l'évolution du droit international". J'estime que ceci confie une tâche très difficile àu Directeur général, parce que ceci inclurait une espèce de jugement de valeur sur ce qui est conforme et ce qui est contraire à l'évolution du droit international.

Nous avions envisagé, lorsque la Commission a recommandé de renvoyer à la prochaine session de la Conférence la considération définitive de projet d'amendement, de distribuer aux gouvernements non seulement des extraits du rapport que vous êtes maintenant en train d'adopter, mais également les procès-verbaux de la Commission et de la Plénière sur ce sujet. Ceci permettrait à tous les Etats intéressés d'arriver à leurs propres conclusions plutôt que de confier la tâche au Directeur général. de se prononcer sur la question de savoir si une disposition ou une proposition d'amendement de caractère juridique est conforme ou contraire à l'évolution du droit international.

M. A. BENDJENNA (Algérie): Je voudrais tout d'abord exprimer mes remerciements à Monsieur le Conseiller juridique, mais je ne suis pas tout à fait d'accord avec lui étant donné qu'il est dit, dans le projet que le Directeur général devra transmettre aux Etats Membres, de faire ressortir les principales vues formulées sur cette question, notamment celles formulées par certains Etats Membres à cette session. Donc, ce n'est pas au Directeur général de donner un jugement de valeur, mais c'est à lui de dire simplement que des Etats Membres ont pris position sur telle ou telle disposition juridique et j'ai bien dit, dans mon intervention de tout à l'heure, qu'il s'agissait justement de préciser mon intervention à ce sujet-là.

W. JURASZ (Poland): As we are coming to the end of the adoption of the reports of Commission III I would like to make the following statement. On behalf of Poland and several delegations of the Socialist countries of Eastern Europe I would like to explain the vote. We voted in favour of the Resolution containing amendments to the General Rules of the Organization concerning the composition of the Programme and Finance Committees. The above-mentioned delegations voted in favour of the Resolution contained in the Report of the Plenary, C 77/REP/2 on the clear understanding that the

Socialist countries of Eastern Europe would be duly represented in the Programme and Finance Committees in accordance with the principle of the well-established practice in the United Nations of securing an equitable geographical distribution. I would ask for this statement to be fully recorded in the Report of the Conference.

H. M. CARANDANG (Philippines): In connexion with document C 77/REP/10 I would like to make an observation in relation to the offer that the Philippines has made to host the World Conference on Agrarian Reform and Rural Development. As this august body heard yesterday, there are several reasons why the Philippines has offered to host the World Conference on Agrarian Reform and Rural Development. They have already been stated and, briefly, they are that the problems on agrarian reform and rural development are located in developing countries and in the Philippines we could see a microcosm of this. Therefore, by holding this Conference in a developing country such as ours we would be able to see the magnitude of the problems encountered and the participants in the Conference both of the developed and developing world would have an opportunity to see for themselves at first hand the magnitude of the problems encountered and the programmes that are being undertaken as a solution to them.

In this connexion I should like to mention the commitment of our Government to agrarian reform and rural development programmes. The main thrust - and the head of our delegation has stated this - is in the programmes that are ongoing. Nevertheless, after consulting with our colleagues here in this Conference and finding out their will, and after consulting with the technical assistants of the Director-General, I have discovered that there are many difficulties involved in holding this Conference in Manila.

Therefore, in deference to the will of the members of this Conference and also after realizing the technical reasons why it should be held in Rome, because we need the technical backstaffing of practically the whole staff of FAO, the Philippines withdraws its offer to host this Conference, in spite of the fact that we thought there were valid reasons for it. I wish to thank everybody for their cooperation in this matter.

CHAIRMAN: I thank the Government of the Philippines and in that case the footnote on the bottom of page 6 referring to that matter, should be deleted.

LI CHEN-HUAN (Chine) (interpretation du chinois): La delegation chinoise a déjà exprimé, hier à la Commission II son point de vue sur le paragraphe 9 de la résolution concernant la Conférence mondiale sur la réforme agraire et le développement rural. M. A. BENDJENNA (Algérie); Ma délégation voudrait proposer un léger amendement au paragraphe 7 à la troisième ligne où il est dit "que la FAO est prête à apporter son aide aux Etats Membres". Après "son aide" ma délégation propose d'ajouter "technique et matérielle", étant donné qu'il est prévu d'une part la préparation des rapports nationaux et d'autre part des officiers de liaison qui devront être en contact entre l'Organisation et les Etats Membres, C'est pour cela que je voudrais insérer les mots "technique et matérielle".

LE DIRECTEUR GENERAL: Je remercie le délégué de l'Algérie de l'intérêt qu'il porte à l'aide de la FAO, qu'il veut à la fois technique et matérielle. Je ne vois aucun inconvénient à accepter cet amendement, étant bien entendu que je resterai limité par les fonds disponibles. De toute évidence, je ne pourrais pas accorder une telle aide technique et matérielle à tous les pays qui me la demanderaient, et c'est donc seulement dans la mesure du possible et dans le cadre de l'enveloppe budgétaire qui me sera accordée que j'essayerai de faire face aux demandes qui me seront présentées.

M. A. BENDJENNA (Algérie): Je tiens d'abord à remercier M. le Directeur général pour ce qu'il vient de me dire, mais les préoccupations de ma délégation concernent surtout certains pays qui ne sont pas à même justement de supporter certains frais. C'est là, M. le Président, la raison pour laquelle j'étais intervene.

H. M. CARANDANG (Philippines): There seems to be some error in the printing of the Report as it was adopted yesterday. If you would allow me to make this observation now I would be willing to do so, otherwise I will abide by your ruling and will hope to be allowed to do it later on.

Yesterday when we were discussing Resolution 77 it was agreed that this would be made to conform with the wording that is in paragraph 14 - in other words, that in the last paragraph of the Resolution on page 6 the words: "representatives of local government agencies" should be included.

I would therefore request that this should be done as it was adopted yesterday, as this might be a misprint.

CHAIRMAN: Will you please repeat on which line that should be brought in.

H. M. CARANDANG (Philippines): As you will notice in paragraph 14, the words are: "It recognized the importance of the participation of the IGOs and NGOs in the World Conference and the desirability of including representatives from the farmers' and agricultural workers' organizations and representatives of local government agencies in national delegations. " In the last paragraph of the Resolution these same words: "representatives of local government agencies'' should be inserted after the words: "rural workers". It is paragraph 6, the last line of the Resolution.

CHAIRMAN: Are there any comments on this proposal made by the delegate of the Philippines?

A. J. PECKHAM (United Kingdom): I am grateful to the delegate of the Philippines for drawing our attention to this. There is obviously an amendment which was passed in Committee, and I was looking around to see whether the Chairman of Commission II was present. In fact, I suggested a re-wording of paragraph 14 which does not appear to have been carried through in the text, and which is consistent with the wording of the final paragraph of the Resolution.


What was agreed in Committee was a recommendation that governments should consider the inclusion in their national delegations of representative bodies. I was responsible for suggesting "representative bodies" because we would then not exclude anyone and it would be open to governments

We then went on to say; "for example, farmers, rural workers and representative organizations" and paragraph 14 of the Report had been amended in that sense. That is why there is an inconsistency, but perhaps it is simply because the Secretariat missed that particular amendment of pagragraph 14. That was my clear understanding, however.

CHAIRMAN: Would you please read me the sentence according to the proposal made during the Commission meeting.

A. J. PECKHAM (United Kingdom): I do so on the basis of memory, but it is the second sentence of paragraph 14 which deals with the importance of IGOs and NGOs in the World Conference, and then it reads: "the desirability of including representative bodies, for example, farmers, rural workers, and representative organizations, " It is exactly the same wording as in the final paragraph of the Resolution.

H. M. CARAHDANG (Philippines): I am sorry to interrupt the discussion, but if I have the correct recollection of what happened yesterday it was an interchange between Jordan and the Philippines, and I do not recollect that the words "agricultural workers" organizations and representatives of local government agencies" were included. These should also be included now.

A. J. PECKHAM (United Kingdom): I apologize for slightly misleading you, Mr. Chairman. I understand that the re-wording of the next to last sentence of paragraph 14 was. as I had given you, but that the final line "and representatives of local government agencies in national delegations" should remain. I apologize for the misunderstanding.

CHAIRMAN: Is there any comment from the Philippines?

H. M. CARANDANG (Philippines): I have no objection, provided the same wording is included in the Resolution.

B. E. MATAMOROS HUECK (Nicaragua): Creo que se trata de una cuestión de traducción solamente. En el texto español, el último párrafo de la resolución dice: "de órganos representativos''. Si no me. equivoco la interpretación sobre la propuesta que se hizo era: "Organizaciones representativas".

Solicito únicamente que se corrija en el texto español y se diga tal como figura en el texto inglés, "Organizaciones representativas'' y no "órganos representativos''.
