Report that we approved on 17 November. The Secretary-General will explain the procedure for these elections.
LE SECRETAIRE GENERAL: Le journal de la Conférence d'aujourd'hui contient en première page un modèle de bulletin de vote pour l'élection des membres du Conseil. En utilisant des noms fictifs de pays, nous avons indiqué la façon correcte de remplir les bulletins qui vont vous être distribués.
Nous allons procéder en deux étapes. La Conférence votera pour la région Europe pour la période novembre 1993-31 décembre 1996; il s'agit là de remplacer le siège laissé vacant par l’ex-Tchécoslovaquie, et nous avons un candidat pour un siège à pourvoir. En même temps, nous procéderons au vote pour la période novembre 1993-31 décembre 1996. La Conférence est appelée à élire: pour l'Afrique, quatre candidats pour quatre sièges à pourvoir; pour l'Asie, cinq candidats pour trois sièges à pourvoir, les deux candidats non élus figureront parmi les candidats pour la période suivante (1er janvier 1995-novembre 1997) à moins qu'ils ne se désistent; pour l'Europe, quatre candidats pour quatre sièges à pourvoir; pour l'Amérique et les Caraïbes, un candidat pour un siège à pourvoir; pour le Proche-Orient, trois candidats pour trois sièges à pourvoir; pour l'Afrique du Sud-Ouest, un candidat pour un siège à pourvoir.
Si nécessaire, nous procéderons ensuite à autant de tours de scrutin qu'il sera nécessaire pour pourvoir les sièges vacants que je viens de citer.
Une fois cette première phase achevée, nous passerons à la deuxième, c'est-à-dire à l'élection des membres du Conseil pour la période allant du 1er janvier 1995 à novembre 1997.
Evidemment, il s'agit là d'une première organisation de vote qui pourrait changer en fonction des résultats du premier tour de scrutin et du nombre de bulletins qui doivent être distribués. Conformément au paragraphe 9 alinéa a) de l'Article XII du Règlement général, ces élections se feront au scrutin secret, même lorsqu'il n'y a pas plus de candidats que de sièges à pourvoir.
Il sera remis à chaque électeur un bulletin de vote distinct pour chacune des régions intéressées. Chaque bulletin doit être rempli conformément aux instructions qui s'y trouvent portées. La majorité requise est spécifiée au paragraphe 3 alinéa a) et d) de l'Article XII du Règlement général.
J'attire votre attention sur le fait que le nombre de sièges à pourvoir varie d'une région à l'autre. Lorsque le nombre de candidats dépasse celui des sièges à pourvoir, il y a lieu de marquer d'une croix la case correspondant à chacun des pays que l'on souhaite voir élire, ainsi qu'il est indiqué sur le bulletin témoin. Conformément au paragraphe 11 alinéa a) de l'Article XII du Règlement général, chaque électeur, à moins qu'il ne s'abstienne, doit voter pour chacun des sièges à pourvoir en désignant un candidat différent pour chaque siège. Tout bulletin qui ne se conformerait pas à ces indications serait déclaré nul. Le paragraphe 4 alinéa c) de l'Article XII du Règlement général prévoit que tout bulletin blanc sera considéré comme une abstention. Le paragraphe 4 alinéa d) du même article précise que les bulletins ne doivent porter aucune indication ni aucun signe autre que ceux par lesquels s'exprime le suffrage. Un bulletin désignant plus de pays qu'il n'y a de sièges à pourvoir sera considéré comme nul; de même, un bulletin désignant moins de pays qu'il n'y a de sièges à pourvoir sera considéré nul. Cela signifie que pour être valable,
un bulletin doit porter exactement autant de croix qu'il y a de sièges à pourvoir.
Je me permets de rappeler qu'en vertu du paragraphe 9 alinéa f) de l'Article XII du Règlement général, tout délégué qui aurait accidentellement rempli un bulletin de manière erronée peut demander un autre bulletin vierge qui lui sera délivré par un fonctionnaire électoral en échange du bulletin défectueux. Le premier tour de scrutin sera suivi d'autant de tours qu'il sera nécessaire pour conclure les élections portant sur la première période. Ensuite, nous procéderons de la même façon pour la seconde période.
CHAIRMAN: Before we proceed to the vote, I would like to say to the Conference that it is proposed that during the counting of the ballots we invite you to accept Draft Report Part II contained in document C 93/REP/2, also C 93/REP/3, which is a Draft Report from Commission I, also C 93/REP/4 and possibly C 93/REP/5. If, in between the counting of the votes, it is possible to deal with these Reports, I will invite Conference to do so.
We will now proceed to vote to fill the seat in the Europe Region vacated by the former Czechoslovakia. This seat will be filled for the period November 1993 to November 1995, that is to say the remainder of the term of office, 1 January 1993 to November 1995.
We will also vote to fill the Council seats for the period November 1993 to 31 December 1996.
I should like to draw the attention of the delegates to paragraph 14 of Rule XII of the General Rules of the Organization, which states that once voting has commenced no delegate or representative may interrupt the voting except to raise a point of order in connection with the voting.
I would like to remind you that Rule XII of the General Rules of the Organization lays down that the quorum for these elections is a majority of the Member Nations, that is to say 85, and I am told that at least 120 delegates are present in the room at this time.
I should also like to appoint two tellers and two alternate tellers to assist the Secretariat in the election process. I will ask the delegates of Mauritius and the Czech Republic to serve as tellers, and the delegates of Barbados and Belgium to serve as alternate tellers.
If there are no comments we shall proceed with the vote.

Je ne suis certain que cela puisse s'insérer au paragraphe 23, mais je suis sûr qu'avec l'aide du Secrétariat, on trouvera la réponse adéquate. Il s'avère que dans les rapports de la Conférence, on ne trouve pas d'informations relatives à la composition et aux Présidents des Comités de rédaction. Cela ne figure que dans le rapport C 93/13 qui émane du Secrétariat, qui expose toute la vie institutionnelle de l'Organisation avec la participation de tous les pays, mais de la même façon qu'on trouve à la fin du rapport de la Conférence, par exemple, la liste des délégués et observateurs qui ont participé à la réunion, on pourrait trouver le moyen de joindre l'information relative à la composition des Comités de rédaction des Commissions. En effet, ils ont participé aux travaux des Commissions, nous permettant d'arriver aux résultats auxquels nous arrivons, aussi je pense qu'il serait utile d'insérer cette information dans le rapport de la Conférence.

Hermann REDL (Chairman of Commission I) (Original language German) : First of all, may I report to you that between 10 and 19 November Commission I had thirteen meetings. In the course of those meetings, the following issues were discussed: Item 6, World Food and Agriculture Situation and Outlook; Item 6.1, State of Food and Agriculture; Item 6.2, World Food Security and Nutritional Status; Item 6.3, World Agriculture Toward 2010; Item 7, Activities Related to Environment and Sustainable Development; Item 7.1, Revision of International Undertaking for Plant Genetic Resources; Item 7.2, International Code of Conduct for Plant Germplasm Collection and Transfer; and Item 8, Plan of Action for the Integration of Women into Agricultural and Rural Development. This was a Progress Report.
The results of our very constructive discussion are to be found in the Reports, which have been provided - C 93/REP/3, C 93/REP/4 and C 93/REP/5. May I take this opportunity to thank those who took part in the discussions in Commission I for their very constructive work. May I now request the Conference to approve the Report of Commission I found in C 93/REP/3

Alvaro GURGEL DE ALENCAR (Brazil): Document C 93/REP/5 contains a very important item, the draft International Code of Conduct for Plant Germplasm Collection and Transfer. In connection with this item, I hope you will allow me to make a brief statement on behalf of the Brazilian delegation. Brazil actively participated in the long negotiations leading to the final draft of the International Code of Conduct for Plant Germplasm Collection and Transfer. My delegation was generally supportive of the terms of the draft and recognized the importance of the Code in fostering the development of legal instruments on access to, and sharing of, benefits, particularly in the short interim period pending the entry into force of the Convention on Biological Diversity. This being the case, the Brazilian delegation does not wish to create any obstacle to the adoption of the draft by the Conference. However, the text before us contains certain concepts and provision which is not in line with the more recent evolution of internationally agreed documents on the subject. Therefore, as the Conference is about to adopt the voluntary Code of Conduct, Brazil feels bound to register its reservations to the text as follows
First, in disagreement with Article 15, paragraph 7, of the Convention on Biological Diversity, which stipulates that the sharing and development, as well as the benefits of its commercial utilization, should be carried out on a fair and equitable basis, the text of the Code of Conduct in Article 1.7 restricts the concept of fair and equitable sharing of benefits when it says, " by suggesting ways in which the users may pass on a share of the benefits to the donors...".
Second, in Article 3.2 the Code states "continued availability of plant genetic resources is a common concern of humankind". This goes beyond what was recognized by the Convention in Article 15. At the same time the Code adds that: "In executing these rights, access to plant genetic resources should not be unduly restricted". This constitutes a limitation of Article 15 of the Convention recognizing the competence of governments in permitting access to genetic resources in accordance with their national law and subject to their previous agreement.
Third, in Article 4 the scope of the Code is defined as, "to ensure that the collection and transfer and use of plant germless is carried out with the maximum benefit to the international community". I stress that it says
"benefit to the international community" rather than "to the benefit of the providers" as would be expected in a post-UNCED document.
Fourth, in Articles 6 to 8 the process indicated for issuing, requesting and granting collection permits does not foresee agreement over the sharing of benefits. According to these Articles, it is incumbent upon the country authority solely to expeditiously accept or deny authorization for the mission, when in fact conditions should be defined for the sharing of benefits derived from the mission.
Fifth, Articles 12 and 13 on responsibilities of sponsors and curators deal specifically with ex situ conservation without referring to the proviso that ex suit conservation should be undertaken preferably in the country of origin, as stated in Article 9 of the Convention.
Sixth, of particular concern to Brazil is the drafting of Article 14 on responsibilities of users, which reads: "Without prejudice to the concept of Farmers' Rights ... users of the germless, should ... consider providing some form of compensation for the benefits derived from the use of germless...". We believe that it is not a question of considering compensation but of mandatory benefit sharing under agreed terms with the country, which provides the resources.
Seventh, as regards Articles 15 and 16, we find the prerogatives granted to the Commission on Plant Genetic Resources somewhat excessive. This applies in particular to the dispute-settlement functions attributed to the Commission as well as to the monitoring procedures envisaged.
Under these circumstances, my delegation requests that the Report of the Conference reflect the Brazilian reservations as well as Brazil's position regarding the adoption of this text. Had there been a vote, Brazil would have at least abstained.
Iávn MARULANDA GOMEZ (Colombia): Queremos manifestar acá en la Conferencia, lo mismo que hemos dicho en los distintos escenarios preliminares en los cuales fue discutido este Proyecto de Código Internacional de Conducta para la recolección y transferencia de germoplasma vegetal, en el sentido de que Colombia acepta las normas contenidas en el Proyecto en cuanto estén en armonía con la Constitución Nacional y las Leyes de la República de Colombia que se ocupan de la materia.
CHAIRMAN: The Secretariat has taken note of the comprehensive statement made by the delegate of Brazil, expressing his reservations - his general support, but his reservations - concerning certain Articles. We also note the comments of the delegate of Colombia.
Conference therefore accepts the draft Report as adopted, with a notation to be made of the comments and reservations of the delegations of Brazil and Colombia. The draft Report of Commission I, document C 93/REP/5 is adopted.
