I. PROCEDURE OF THE CONFERENCE

II. CONSTITUTIONAL AND LEGAL QUESTIONS

5. Interpretation of Date of Membership:

At its Special Session held in November 1950, the Conference made a provisional ruling to settle a controversy that had arisen regarding the actual date when the membership of certain members of the Interim Commission had become effective. It requested the Council to study all the implications of this ruling so that final settlement could be made at the Sixth Session of the Conference (See Report of Special Session, pp. 2 and 3)

6. Admission of New Members to the Organization (Rule XIX)

(a) Application for membership from Argentina, Japan and Nepal

(b) Suspension of Rule XIX.2 of the Rules of Procedure in the case of the application of Laos, which reached the Director-General after the established deadline

(a) Tenure of office of Members of the Council:

A proposal will be placed before the Conference suggesting an amendment to Rule XXIII of the Rules of Procedure which determines the term of office of the Members of the Council

9. Appointment of the Chairman of the Council:

Article V of the Constitution provides that the Conference shall appoint an independent Chairman of the Council, and Rule XXIV specifies that this appointment shall be for two years, and shall be placed on the agenda of each regular session of the Conference

10. Appointment of the Director-General: The Special Session of the Conference reappointed the Honorable Norris E. Dodd as Director-General of FAO until the end of the next regular session of the Conference (See Report of Special Session, p. 4)

11. Amendments to the Constitution and to the Rules of Procedure

12. Emergency Action to Assist the United Nations in the Maintenance of Peace and Security:

The Economic and Social Council has requested Specialized Agencies to determine the procedures whereby they would lend their assistance to the General Assembly and other organs of the United Nations in times of an emergency endangering the maintenance of peace and security

13. International Plant Protection Convention:

At its Special Session in November 1950, the Conference determined the procedure to be followed in order to permit final action at the Sixth Session on the draft International Plant Protection Convention

14. Establishment of Latin American Fisheries Council:

In conformity with a resolution of the Second Latin American Regional Meeting, held in Montevideo in December 1950, an agreement setting up a Latin American Fisheries Council will be presented to the Conference for approval

15. Resolution of the Economic and Social Council Concerning the International Office of Epizootics:

The Economic and Social Council urges that every effort be made to establish a single, effective, international system for the collection and dissemination of information and for the co-ordination of activities for the control of animal diseases

16. Status of European Committee on Agricultural Technology:

The European Committee on Agricultural Technology at its third meeting held in Rome, June 1951, prepared a draft resolution requesting the Conference formally to establish the Committee and to lay down terms of reference for it

A Conference decision is required concerning the contributions to the International Institute of Agriculture which are still outstanding

It is anticipated that requests may be received from the Specialized Agencies and other international organizations for use of Headquarters Conference facilities. If it is decided to grant these requests, some adjustment in the Financial Regulations and budgetary procedure will be required

NOTE. - This form for facilitating the exchange of forest seeds and plant material for scientific use, has been approved by the Sixth Session of the Conference of FAO with the following recommendations:

"1. that in order to establish authenticity, Member Governments take steps to adopt the Certificates of Quality and Origin which are contained in Appendix B; and,

2. that, to expedite the exchange of seeds and plants for scientific purposes, Member Governments secure recognition by appropriate national agencies of the standard Consignment Form contained in same Appendix."

The weight of the package must not exceed I kilogram (approximately 35 ounces); the stamp or seal (if possible) of the institution and the signature of the official responsible for shipment must appear on it.

C. Draft agreement between the organization of American States and the Food and Agriculture Organization of the United Nations

(Approved by the Committee on Inter-American Organizations of the Council of the Organization of American States, on 18 May 1951)

THE ORGANIZATION OF AMERICAN STATES AND THE FOOD AND AGRICULTURE ORGANIZATION OF THE UNITED NATIONS

Wishing to co-ordinate their efforts to give effect, within the terms of the Charter of the United Nations, the Charter of the Organization of American States, the Constitution of the Food and Agriculture Organization of the United Nations, the Convention of the Inter-American Institute of Agricultural Sciences, and other applicable instruments, agreements, resolutions and declarations, to their respective principles and objectives;

Desirous of avoiding overlapping and duplication of activities while contributing to the effective accomplishment of the said principles and objectives; and

Determined to continue and expand, on a firm basis, the co-operative relationships already so happily established between them, Have agreed upon the following:

ARTICLE I
Co-operation

1. The Organization of American States and the Food and Agriculture Organization of the United Nations agree to co-operate with each other through their appropriate bodies.

2. This co-operation shall extend to the different matters that arise in the fields of agriculture, food, animal industry, forestry, and fisheries and in general, all those matters within the competence of the two organizations that are connected with activities in which the two organizations have a common interest.

ARTICLE II
Mutual Consultation

1. The Organization of American States and the Food and Agriculture Organization of the United Nations, will consult each other regularly through their appropriate offices on matters of common interest with a view to attaining their objectives and coordinating their respective functions.

2. The Food and Agriculture Organization of the United Nations will inform the Organization of American States of any plan for the development of its regional activities in the Americas, and will consider any observations concerning such plans that may be communicated to it by the Organization of American States with a view to accomplishing effective co-ordination between the two organizations.

3. The Organization of American States will inform the Food and Agriculture Organization of the United Nations of any plans for the development of its activities in connection with matters of interest to the Food and Agriculture Organization of the United Nations, and will consider any observations concerning such plans that may be communicated to it by the Food and Agriculture Organization of the United Nations, with a view to accomplishing effective co-ordination between the two organizations

4. When circumstances so require, special consultations will be arranged between representatives of the two organizations to agree upon the most effective manner in which to organize particular activities and to secure the fullest utilization of the resources of the two organizations.

ARTICLE III
Joint Action

1. The Organization of American States and the Food and Agriculture Organization of the United Nations may, through their competent organs, conclude special agreements or arrangements for joint action with a view to attaining objectives of common interest.

2. These agreements or arrangements shall carefully define the manner and extent of participation by each organization, and shall specify the financial commitment, if any, that each is to assume.

3. The two organizations may likewise set up joint committees, when they deem it advisable, to which matters of mutual interest are referred. Any such committee shall consist of an equal number of representatives of the two organizations, the number to be determined by mutual agreement.

ARTICLE IV
Exchange of Information and Documents

1. The fullest and promptest exchange of information and documents concerning matters of common interest will be made between the Organization of American States and the Food and Agriculture Organization of the United Nations, without prejudice to the arrangements that may become necessary in order to preserve the confidential character of certain documents.

2. The Organization of American States will be kept informed by the Food and Agriculture Organization of the United Nations of developments in the work of the Food and Agriculture Organization of the United Nations which are of interest to the Organization of American States.

3. The Food and Agriculture Organization of the United Nations will be kept informed by the Organization of American States of developments in the work of the Organization of American States which are of interest to the Food and Agriculture Organization of the United Nations.

ARTICLE V
Reciprocal Representation

1. The Food and Agriculture Organization of the United Nations will invite the Organization of American States to be represented at the sessions of the Conference and the meetings of the Council of the Food and Agriculture Organization of the United Nations, as well as at the regional conferences held under its auspices in which members of the Organization of American States participate. The representatives of the Organization of American States may participate without vote in the deliberations of these bodies and of their committees with respect to matters in which the Organization of American States is interested.

2. The Council of the Organization of American States, in preparing the Regulations of the Inter-American Conference, which are to be submitted to the governments for consideration, shall include an article that permits the Food and Agriculture Organization of the United Nations to be invited to be represented at the Inter-American Conference when the topics of the program may be of interest to it.

3. With reference to inter-American specialized conferences, the Council of the Organization shall recommend to the corresponding organization or entity that an invitation be extended to the Food and Agriculture Organization of the United Nations to be represented in those conferences whenever the items in their programs may be of interest to the Food and Agriculture Organization of the United Nations.

4. In both cases, such representatives may participate without vote in the conference indicated.

5. Appropriate arrangements may be made by agreement from time to time for the reciprocal representation of the Organization of American States and the Food and Agriculture Organization of the United Nations at other meetings convened under their respective auspices which consider matters in which the other organization has an interest.

ARTICLE VI
Suggestions for the Inclusion of Agenda Items

1. Subject to such preliminary consultation as may be necessary, the Inter-American Conference, the Council of the Organization of American States, the Inter-American Economic and Social Council, and the Board of Directors of the Inter-American Institute of Agricultural Sciences may suggest items for inclusion in the agenda of the Conference and of the meetings of the Council of the Food and Agriculture Organization of the United Nations. The Food and Agriculture Organization of the United Nations may suggest items for inclusion in the agenda of the meetings of the organs of the Council of the Organization of American States, the Board of Directors of the Inter-American Institute of Agricultural Sciences, and of other pertinent inter-American meetings.

2. Each organization, in accordance with the provisions of this Article, may submit to the consideration of the other, matters which it considers can most appropriately be dealt with by that organization.

ARTICLE VII
Administrative Arrangements

1. The Secretary-General of the Organization of American States, and the Director-General of the Food and Agriculture Organization of The United Nations will make such administrative arrangements as may be necessary to ensure effective collaboration and liaison between the staffs of the two organizations.

2. They may also make administrative arrangements defining the part to be played by regional offices in liaison between the two organizations.

ARTICLE VIII
Modification and Denunciation

1. The present Agreement will enter into force from the date on which it is signed by the authorized representatives of the Organization of American States and the Food and Agriculture Organization of the United Nations.

2. The Agreement may be modified with the consent of the two parties.

3. Either of the parties may denounce the Agreement by giving six months notice to the other party.
