| Abstract:
| This Act introduces the Agricultural and Veterinary Chemicals Code.The text of the Code is divided into 13 Parts: Preliminary (1); Approvals and registration (2); Liable chemical products (2a); Reserved chemical products (2b); Compensation for provider of certain information in respect of continued registration of certain chemical products (3); Control of chemical products (4); Analysis (5); Recall notices (6); Permits (7); Enforcement (9); Miscellaneous (10); Transitional provisions (11).The object of the Code is to make provision for and in relation to: (a) the evaluation, approval, and control of the supply, of active constituents for proposed or existing agricultural chemical products or veterinary chemical products; and (b) the evaluation, registration, and control of manufacture and supply, of agricultural chemical products and veterinary chemical products (sect. 1). Section 4 defines "agricultural chemical product"; section 5 defines "veterinary chemical product". A person may apply to the National Registration Authority, established by the Agricultural and Veterinary Chemicals (Administration) Act of 31 August 1996 for: (a) the approval of an active constituent for a proposed or existing chemical product; or (b) the registration of a chemical product; or (c) approval of a label for containers for a chemical product (sect. 10). The NRA shall keep a Register of Agricultural and Veterinary Chemical Products (sect. 18). Approval of active constituents or registration of a chemical product must be made known through notices published by the NRA (sect. 52). Part 4 restricts the possession of unapproved constituents and unregistered products for the purpose of supplying them and the supply of such products or materials and the supply of registered products or materials in contravention of their approval or registration (sect. 72). Part 5 sets out the procedure by which samples or substances are to be analysed and states how evidence of the results of the analysis may be given in proceedings under this Code. Part 7 provides for a system of permits for acts in respect of active constituents or chemical products that would otherwise be prohibited by this Code or other existing laws. Part 8 (a) prohibits the manufacture of certain chemical products; and (b) provides for the licensing of manufacturers of other chemical products. The Act is amended last by Schedule 1 (items 4-7) only of the Gene Technology (Consequential Amendments) Act 2000. (Sections and Parts in this abstract mean sections and Parts of the Code). |
