| Abstract:
| The Act consists of 40 sections divided into VI Parts: Preliminary (I); Objects of this Act (II); Administration (III); Heritage Agreements and financial and other assistance (IV); Clearance of native vegetation (V); Miscellaneous (VI).An authority called the Native Vegetation Council is established under section 7. The presiding member shall be nominated by the Minister and all 7 members appointed by the Governor (sect. 8). The Council shall provide advice to the Minister and keep the native vegetation condition under review. A Native Vegetation Fund is established under section 21. The Fund shall be managed by the Council. The Council may make payments from the Fund in accordance with this Act. The Minister may enter into a heritage agreement with the owner of land on which native vegetation is growing or is situated (sect. 23). A heritage agreement may contain any provision for the preservation or enhancement of native vegetation (sect. 23A). The Council must keep a register of heritage agreements entered into under this Act and must include in the register any agreement varying or terminating a heritage agreement (sect. 23B). An owner of land that is subject to a heritage agreement may apply to the Council for financial or other assistance (sect. 24). |
