Abstract: These Rules mainly define tasks of the Department and Agriculture for the purpose of implementing through Board of Fisheries and Aquatic Resources (BFAR) provisions of the Fisheries Code of the Philippines of 1998. The 131 rules are divided into 9 Chapters: Declaration of policy and definitions (I); Utilisation, management, development, conservation and allocation system of fisheries and aquatic resources (II); Reconstitution of the Bureau of Fisheries and Aquatic Resources and creation of Fisheries and Aquatic Resources Management Councils (III); Fisheries reserves, refuges, and sanctuaries (IV); Fisheries Research and development (V); Prohibitions and penalties (VI); General provisions (VII); Transitory provisions (VIII); Final provisions (IX).As the Fisheries Code these rules apply all sovereign waters and the EEZ of the Philippines and to private and public lands reserved for fisheries and fish farming business and rule 3 sets out the powers of jurisdiction of authorities involved in implementation. Rules 5 to 14 set out tasks of the Department of Agriculture with this assistance of the Board of Fisheries and Aquatic Resources (BFAR). Rules 16 to 25 provide for municipal (local) fisheries, whereas rules 26 to 44 provide for commercial fisheries. Other provisions of Chapter II concern aquaculture (rules 45 to 57) and post harvest facilities and activities and trade in fish products (rules 58 to 62). The post of Under-secretary of Fisheries and Aquatic Resources is created in the Department under rule 63. Rule 69 provides for the creation of Fisheries and Aquatic Resources Management Councils. Rule 86 concerns the regulation of sport fishing. Fisherfolk settlement areas shall be created under rule 108 by the Department through BFAR. Rule 123 concerns the designation of navigation lanes. Rule 131.1 provides for amendment of various other rules and regulations so as to harmonise their content with the Code and the present Rules.
