Forestry legislation

Niue has yet to formulate formal government legislation dealing with forestry, but in recent years, extensive work has been undertaken to establish a policy framework for Niue¿s forestry sector through the development of the National Forest Policy (2001) and the Code of Harvesting Practice for the Indigenous Forests of Niue (2003). While adopted by government, these policies are currently not implemented in Niue¿s laws. The need for a legal framework in the forestry sector is longstanding, having been identified since as early as 1993. The National Forest Policy establishes a framework for action by providing guidelines for coordinated decision-making, regulation and implementation of programmes and activities.

Other relevant environmental legislation include the Wildlife Ordinance of 1972, which protects listed birds and the fruit bat (Pteropus tonganus), the 2003 Environment Bill, an umbrella law that establishes an administrative framework for the Government¿s Environment Unit and Sustainable Development Council, and the 1995 Domestic Fishing Act, which provides a useful model of natural resource management legislation. Additionally, the Niue Government has adopted an Integrated Strategic Plan for the development of Niue over the period 2003-2008. The Plan has strategic objectives dealing with financial stability, governance, economic development, social development and the environment. Its guiding principles include sustainable development, stakeholder alliances, communication and consultation and accountability. The Plan emphasizes the role of vanilla production, tourism and fisheries for Niue¿s future growth. The emphasis on sustainable development promotes conservation, not exploitation, of Niue¿s natural resources.
