立法评估工具按 30 个法律指标分析了各个国家法律框架,以期为参与国家提供及时、有针对性、有效的政策建议,实现土地保有权上的性别平等。

How does it work?

The LAT offers a scroll-down list of legal indicators for gender-equitable land tenure. They focus on the elimination of gender-based discrimination in the constitution, in inheritance, nationality, property rights and access to justice among others. 

When selected, the indicator will reflect to what extent a country has incorporated the indicator into its national legal framework. The results are shown visually and in different colour ranges on an interactive map specially designed for this purpose on a scale from 0 to 4. Background information

How are the LAT assessments carried out?
- They cover three sources of law: constitutions, statutes and regulations;
- They rely primarily on the information contained in the various sections of the country profiles;
- They are reliable and accurate: the stages are identified using the actual text of the legislation, referencing all relevant legal provisions. 

Promoting an integrated system of land tenure
The LAT promotes the incorporation of informal normative systems into the general legal system. Customary and religious sources of law are only covered insofar as they are incorporated into the general legal system.

A de jure analysis of the legislation pertaining to gender and land
It is outside the scope of the LAT to engage in a de facto analysis of gender equity in land tenure.

Breaking down the different stages in policy and law-making processes
Because legal reform should take place inside a policy framework, the LAT analyses the policy environment and the legal framework simultaneously. Each stage is assigned a score:
