AGREEMENT FOR THE ESTABLISHMENT OF
THE GLOBAL CROP DIVERSITY TRUST

The Agreement for the Establishment of the Global Crop Diversity Trust and its Constitution were approved by the Interim Panel of Eminent Experts at its Second Meeting which took place in Rome on 2-4 October 2003. In accordance with Article 4 of the Agreement, it was opened for signature at FAO Headquarters on 1 April 2004 and remained open for signature until 31 March 2006 by all Members of FAO and any States that are not Members of FAO but are Members of the United Nations, or any of its specialized agencies or of the International Atomic Energy Agency.

Under Article 4, the Agreement shall be open for accession by all Members of FAO and any States that are not Members of FAO but are Members of the United Nations or any of its specialized agencies or of the International Atomic Energy Agency from the date on which the Agreement is closed for signature.  Instruments of accession shall be deposited with the Director-General of FAO.

Article 5 of the Agreement provides that it shall come into force immediately upon signature or accession by seven States, provided that such States include at least four developing countries and include States from at least five of the seven FAO regions as referred to in the Basic Texts of FAO. Having reached the required signatures, the Agreement entered into force on 21 October 2004.

1. On 12 June 2006, the Director-General received a notification informing that the Republic of Serbia is continuing the membership of “Serbia and Montenegro” in FAO and all its organs, on the basis of Article 60 of the Constitutional Charter of Serbia and Montenegro, activated by the Declaration of Independence adopted by the National Assembly of Montenegro on 3 June 2006, and that the name “Republic of Serbia” is to be henceforth used instead of the name “Serbia and Montenegro”.
