D. Statement by the director-general concerning China

(Delivered in Plenary in the afternoon of Tuesday, 23 November 1971)

Mr. Chairman,

I should like to use this opportunity to submit to the Conference a question of great importance on which I would like to obtain your guidance, that is the question of China.

As you know, the General Assembly of the United Nations adopted on 25 October 1971 Resolution 2758 (XXVI) restoring the lawful rights of the People's Republic of China in the United Nations and "in all the Organizations related to it". This Resolution was formally brought to the attention of all Specialized Agencies by the Secretary-General of the United Nations and in response to it the Council authorized me on 2 November 1971 to invite the People's Republic of China to seek formal membership in FAO and, if it so wished, to attend the present session of the Conference; this decision was transmitted on the same day by cable to Prime Minister Chou En Lai' the relevant part of the Report of the Council together with the text of the statement I had made before the Council has been brought to the attention of the Conference in Document C 71/INF/11. Today I received a cable from the Acting Minister of Foreign Affairs of the People's Republic acknowledging receipt of my cable, reading as follows:

"Mr. A. Boerma, Director-General, Food and Agriculture Organization of the United Nations, Rome.

'Your cable of November 2 has been received with regard to your authorized invitation to our country to be a formal member of the Food and Agriculture Organization and attend the Conference being held in Rome. I have the honour to inform you that because of the shortage of time we do not plan to send persona to attend the Conference presently in session. Highest consideration'

While, as you will note, no reference was made in this cable to formal membership in FAO, there is reason to believe that China will be interested in resuming its place in the Organization and it may well be that a positive move will be made after the close of the Conference session.

Before submitting for your guidance the questions and alternatives with which I would be faced in that case, I should like to recall briefly the historical background concerning China's position in FAO:

- In 1943 China participated in the Hot Springs Conference which was the first step for the foundation of this Organization.

- On 16 October 1945 China signed the FAO Constitution and became an ''original" member by virtue of Article XXI and Annex I of the Constitution.

- On 30 September 1949 the People's Republic of China was proclaimed, the Government of which by that time controlled the whole mainland of China.

- On 18 November 1949, Foreign Minister Mr. Chou En Lai addressed a telegram to the Secretary General of the United Nations affirming the right of his Government to represent China in the United Nations; in the ensuing debates in the United Nations, reference was also made to the question of representation in the Specialized Agencies.

- On 12 May 1950 a similar telegram was addressed by Chou En Lai to the Director-General of FAO; the telegram was circulated to Member States and the Council at its Ninth Session taking place at the time. However, no action was taken by the Council or the Conference on this matter.

- On 15 December 1950 the General Assembly of the United Nations adopted a Resolution - Resolution No. 396 (V)-recommending that in controversial questions of representation the attitude of the General Assembly should be taken into account in the Specialized Agencies.

- On 27 July 1951 the Government of the "Republic of China'' (Taiwan) notified its intention to withdraw from FAO with effect from 21 July 1952.

- Since the recent General Assembly Resolution, that is the Resolution of 25 October 1971, restoring its rights to the Government of the People's Republic of China, a number of Specialized Agencies (i.e. Unesco, ILO and ICAO) have already taken action similarly recognizing this Government as the legitimate representative in those organizations. A similar action was taken by GATT.

I feel it is necessary now for the Conference to consider the ways by which China could resume its place also in our Organization. As I mentioned before, China was an ''original'' member, that is to say it became a member in accordance with Article XXI of the Constitution simply by depositing an instrument of acceptance and signing the Constitution; as for all original members, no Conference vote on admission was required. I should also like to point out that in two other cases where original members had withdrawn from FAO and subsequently wished to rejoin the Organization, this was effected by the normal admission procedure by a two-thirds majority vote of the Conference and not by following the simplified procedure I just mentioned.

Now, what would happen if the People's Republic, after the end of this Conference session, expressed its desire to be again a full member of FAO? Should the procedure followed in the two previous cases be applied to this case, this would mean that China could only be admitted in two years time at the next regular session of the Conference or at a special session convened for the purpose. In view of the delay involved in the event of admission at the next regular session, and the somewhat cumbersome and expensive procedure obtaining in case of a special session, both solutions would seem to be undesirable for the Organization, and possibly for China itself. I should like to recall in this connexion that all delegations which have spoken on the subject, during the Fifty-Seventh Session of the Council, and also during the present session of the Conference, expressed the hope that the People's Republic of China would resume in the near future its place in the Organization. Some delegations particularly stressed the necessity for a speedy and unformalistic attitude in this matter.

I have been advised that it would be legally possible for the People's Republic of China to resume, without being formally readmitted, the seat of China if it so wishes, since the notice of withdrawal given in 1951 by the Government of the ''Republic of China'' (Taiwan) emanated from a Government whose right to represent the State of China had already at that time been formally contested. This notice of withdrawal would not be held against the Government of the People's Republic of China which had no part in it and which has now been recognized as being the legitimate representative of China. This Government has indeed not been in a position to exercise, since the time of its establishment in 1949, the membership rights in FAO and has been prevented from making its contribution to the achievement of the aims of the Organization. Even if the People's Republic had wished in the past to take its place in FAO, it may be assumed that it would not have been recognized as the legitimate representative of China in view of the position taken by the United Nations General Assembly in the past, which, as I said earlier, was to be taken into account by the Specialized Agencies.

Under the present circumstances, the Government of the People's Republic, which has been recognized as the legitimate representative of China, should not, in my personal view, be deprived of the possibility of availing itself of the rights deriving from original membership in the Organization. As a consequence, it would be permissible for the People's Republic to resume its place in FAO without any special formality. In that event, it would not be necessary to defer the matter until 1973 or to convene a special session of the Conference.

If the Conference agrees with this approach it may wish to authorize me to inform accordingly the Government of the People's Republic of China and to make, at the appropriate time, and, where necessary, after consultation with the competent organs of FAO such arrangements as may be required to enable China to resume its place in the Organization.
