Synopsis (short abstract) This brochure gives a summary overview of four international binding fisheries instruments (conventions and agreements) that promote the safety of fishing vessels, safety of fishers, training of fishers, and responsible and safe fisheries operations. This brochure has been prepared by IMO, ILO, and FAO to provide guidance to policy and decision-makers and other stakeholders in the fisheries, maritime, and labour sectors with a view to promote ratification and implementation of the following fisheries instruments: 1. The IMO (2012) Cape Town Agreement (CTA) 2. The IMO (1995) International Convention on Training, Certification and for Fishing Vessels Personnel (STCW-F) 3. The ILO (2007) Work in Fishing Convention (C188) 4. The (2009) FAO Agreement on Port States Measures to Prevent Deter and Eliminate Illegal, Unreported and Unregulated Fishing (PSMA) In addition, information is provided on voluntary instruments relevant to safety in the fisheries sector, such as the 1995 FAO Code of Conduct for Responsible Fisheries, various safety codes, safety recommendations, and technical and implementation guidelines. The policy brief aims at fostering wide ratifications and implementation of the above-mentioned instruments, in line with Agenda 2030 and in particular with support governments in achieving commitments toward SDG 8 Promote sustained, inclusive, and sustainable economic growth, full and productive employment and decent work for all and SDG 14 Conserve and sustainably use the oceans, seas and marine resources for sustainable development.

    In accordance with the recommendations of the Committee on Fisheries (COFI), FAO prepared the first draft of the technical guidelines in relation to Fishing Operations, which were submitted to the Technical Consultation on the Code of Conduct for Responsible Fishing, Rome, 26 September to 5 October 1994. The draft was prepared taking into account the Declaration of Cancún, Agenda 21 of United Nations Conference on Environment and Development (UNCED) and the Report of the Expert Consu ltation on Responsible Fishing Operations, Sidney, British Colombia, Canada, 6 -11 June 1994. Thereafter, the draft was revised taking into account, the negotiations at the UN Conference on Straddling Fish Stocks and Highly Migratory Fish Stocks, the elaboration of the Code as well as developments at the International Maritime Organization (IMO) with regard to the Protocol to the Torremolinos International Convention on Fishing Vessel Safety and the new International Convention on Training, Certification and Watchkeeping for Fishing Vessel Personnel, 1995. Technical Guidelines are given in support of the implementation of the Code in relation to fishing operations. These are addressed to States, international organizations, fisheries management bodies, owners, managers and charterers of fishing vessels as well as fishers and their organizations. Guidance is also given with respect to the general public.

    Implementation Guidelines on Part B of the Code, the Voluntary Guidelines and the Safety Recommendations 2014

    The Implementation Guidelines are intended for the attention of maritime, labour and fisheries ministries and any other relevant government ministry as and when it is decided to implement the three FAO/ILO/IMO instruments on the design, construction and equipment of fishing vessels of all types and sizes. Those instruments are Part B of the Code of Safety for Fishermen and Fishing Vessels, the Voluntary Guidelines for the Design, Construction and Equipment of Small Fishing Vessels, and the Safet y Recommendations for Decked Fishing Vessels of Less than 12 metres in Length and Undecked Fishing Vessels. While the intention is not to provide a single prescription to improve safety, the Guidelines do seek to raise awareness and offer guidance on a broad range of issues which must be addressed in an effective and holistic manner. In this regard, the cooperation and coordination between maritime, labour and fisheries administrations is important, particularly where the responsibilities for safety of fishing vessels are divided under relevant Acts. The Implementation Guidelines cover areas such as: development of a safety strategy; legal implications; administrative requirements; capacity-building; training of crew members; enforcement of regulations; and operational safety. Although the main purpose of the Implementation Guidelines is to assist competent authorities in the implementation of voluntary instruments, it could also be useful when implementing the provisions of the Cape Town Agreement of 2012 on the Implementation of the Provisions of the 1993 Protocol relating to the Torremolinos International Convention for the Safety of Fishing Vessels, 1977.
