FAO publishes Explanatory Note to help countries improve food safety laws in the Africa region

FAO has released a new Explanatory Note on the Guidelines for Developing Harmonized Food Safety Legislation for the CCAFRICA Region (CXG 98-2022).  These Guidelines were adopted in 2022 by the FAO/World Health Organization (WHO) Coordinating Committee for Africa (CCAFRICA). This Committee is mandated to exercise general coordination in the preparation of standards relating to the region of Africa.

Drafted by the Development Law Service (LEGN) of the Legal Office in collaboration with the Agrifood Systems and Food Safety Division (ESF), the Explanatory Note is intended to assist Members in the preparation of food safety legislation - whether by developing new laws, adopting regulations, or revising existing provisions.

The note seeks to promote harmonization of legislation among Members by encouraging a consistent interpretation of the Guidelines. It further clarifies whether the legislation is intended exclusively for public health purposes or whether, in addition to protecting consumer health, it also aims to safeguard economic interests, including fair commercial practices.

The publication also offers straightforward explanations on topics not detailed in the Guidelines, such as the difference between food and animal feed, when a food product is considered “on the market”, and how products can be traced along the supply chain. It highlights the importance of consulting consumers, producers and other groups when preparing laws, and notes that decisions should be based on available scientific information.

The publication is part of FAO’s Food Safety and Quality Series and is available online in English and in French.
