The Right to Adequate Food

Author: Office of the United Nations High Commissioner for Human Rights

Joint FAO-OHCHR Fact Sheet No. 34, 2010.

This study is an important technical tool for everyone working on the right to food and on its implementation at any level. Access to justice is recognized as an essential component of the Right to Food Guidelines and is essential to protect victims of violations of such right. This publication shows that traditional arguments against justiciability are outdated today and that access to justice therefore is possible. To this end, it is important to increase awareness and develop capacities of lawyers and judges to defend this right. This study provides different examples of access to justice at national, regional and international levels, and of judicial and quasi-judicial mechanisms to respect, protect and fulfil the right to food.

In addition, this Fact Sheet also explains what the right to adequate food is, illustrates its implications for specific individuals and groups, and elaborates upon State parties’ obligations with respect to this human right.

This is a joint FAO-OHCHR Fact Sheet from 2010, published by the Office of the United Nations High Commissioner for Human Rights in Geneva.
