LEGISLATION Community vessels fishing In third Country waters -Community vessel shall obtain fishing licence granted by third country's relevant authorities. (Art. 2(a)) -Community vessel flying the flag of the member state, shall obtain from the flag's member state, an authorization for fishing within framework of the fisheries agreement between EEC/third country. (Art. 2(b)) -Flag's member state shall not allow fishing authorization to vessel which does not hold a regular licence in compliance with relevant Community rules. -Flag's member state shall deliver, without delay, fishing authorization when fishing licence has been granted by third country. (Art. 4) -Member state shall transmit to the Commission licence applications, from the vessels flying its flag. -Member state shall control that licence applications comply with arrangements and fishing possibilities set within the fisheries agreement. (Art. 5) (Council Regulation No. 3317/94 of 22 December 1994 laying down general provisions for fishing in third Countries waters within framework of fisheries agreements) Vessels from third Countries fishing in Community waters -Fishing licence and special fishing permit can be allowed by the Commission, to vessels flying the flag of third countries. -Licence and special permit to non-members vessels, include minimum data concerning the identification, the technical characteristics and fitting out of that vessel. -Licence and special permit to be supplemented by a prior authorization enabling the vessel, to carry out its activities in Community fishing waters in accordance with relevant provisions of Community law and the fisheries agreement concluded with the country in question. (Art. 2) -Third-country shall transmit to the Commission applications, including specified data, for vessels which are likely to engage in fishing activities within the framework of fishing possibilities granted by the Community to that country. (Art. 9) (Council Regulation No. 1627/94 of 27 June 1994. laying down general provisions concerning special fishing permits) Fishing vessels from Sweden For 1995: -Fishing activities in divisions III(c), (d) and IV subject to the following: - prior fishing authorization from the Commission; - notification from each application of vessel name, registration number, external identification markings, registered port, name and address of shipowner or charterer, GRT and overall length, engine power of vessel, call sign and radio frequency, intended fishing zones and methods, intended target species, period for which authorization requested. -Number of prior fishing authorizations issued cannot exceed: 95 for fishing sprat, cod and herring in the Baltic Sea; 57 for fishing herring, sprat and mackerel in ICES Divisions IVa and IVb; 25 for fishing cod, haddock, whiting and other species m ICES Division IV. -Each authorization valid for one vessel and for maximum one year. -Logbook may be maintained m a prescribed way and include specific data. (Commission Regulation No. 3237/94 of 21 December 1994. implementing waters access regime, as defined in EEC Accession Act from Norway. Austria Finland and Sweden) -Until implementation date of Community fisheries licensing regime, Swedish vessels may undertake fisheries activities in Community waters, under the same conditions as those existing, just before entry into force of Accession Treaty. -Swedish fishing possibilities, for species submitted to catch limitations, set as a percentage of those allocated to the Community, according to species and respective quota in the different zones. -For species outside these catch limitations, fishing possibilities are set quotas by species and zone: for sprat ICES Divisions IIa, IV = 1 330 t.; others in ICES Divisions IIa, IV = 1 000 t. (Accession Act to EEC, Official journal of 29 August 1994. p. 41) Fishing vessels from Finland For 1995: -Until implementation date of Community licensing regime, Finnish vessels may undertake fisheries activities in Community waters, in the same conditions as those existing, just before entry into force of Accession Treaty. -Finnish fishing possibilities, for species submitted to catch limitations, set as a percentage of those allocated to the Community, according to species and respective quota in the different zones. (Accession Act to EEC, Official journal of 29 August 1994, p. 38) Non-member vessels fishing in Guyanese fishing zone See supra for general conditions applying to Norwegian fishing vessels. -Licences for shrimp fishing may be issued only to vessels flying the flag of: (i) Barbados = 24 t. for 5 licensed vessels, with maximum 200 days at sea; (ii) Guyana = 24 t. for 5 licensed vessels, with maximum 200 days at sea; (iii) Suriname = p.m. (iv) Trinidad and Tobago = 60 t. for 8 licensed vessels, with maximum 350 days at sea. -Licence for shrimp fishing shall be issued on the basis of a fishing plan submitted by the authorities of the country concerned, approved by the Commission. -Period of validity of shrimp fishing licence shall be limited to the fishing period provided for in fishing plan. -Licences for fishing of other species shall be granted as follows: - tuna fishing allowed to Japan and Korea, with maximum number of licences p.m.; - snappers fishing allowed to Venezuela and Barbados with respective maximum of 41 and 5 licenses; - shark fishing allowed to Venezuela, with maximum 4 licences. -Snapper fishing licences shall be granted, provided that the owner lands 75% of the catches in Guyana; for shark fishing licences percentage is 50%; licence applicant to produce proof of existing valid contract, including such local landing obligation, with a processing undertaking situated in Guiana. -Fishing of certain shrimp species prohibited in waters of less than 30 meters. -Only longlining authorized for tuna fishing; only longlining and trap for snapper fishing; for shark fishing, only long lines or mesh net of minimum 100 m.m. authorized, in waters of more than 30 meters. -Observer can be required on board. LEGISLATION Conditions applying to Swedish vessels -After each haul: (i) catch quantity by species; (ii) date and time of haul; (iii) geographical position in which the catch was made; (iv) fishing method used. -After each transhipment to or from another vessel: (i) indication of "received" or "transferred to"; (ii) quantities or each species transhipped; (iii) name, identification markings of the vessel to/from which transhipment occurred. -After each transmission of information to the Community: (i) date and hour of transmission; (ii) type of message; (iii) radio station name if relevant.
