Les certificats ne devraient être requis que lorsqu’ils sont nécessaires pour garantir l’innocuité du produit ou la loyauté des pratiques commerciales.

3. Les présentes directives concernent la conception et l’utilisation de certificats officiels ou [officiellement agréés] qui attestent les attributs de denrées alimentaires destinées au commerce international. Les certificats ne devront être requis que lorsqu’ils sont nécessaires pour garantir l’innocuité et la salubrité des produits ou pour faciliter les échanges.
4. Les présentes directives ne traitent pas des questions de santé animale ou végétale, lesquelles ne relèvent pas du mandat du Codex. Il est toutefois reconnu que, dans la pratique commerciale, les certificats pourront contenir des informations s’y rapportant.
5. Les présentes directives envisagent l’usage possible de certificats sous format papier et électronique.

PRINCIPES
6. Les certificats ne devront être requis que lorsqu’ils sont nécessaires pour garantir l’innocuité des produits ou pour faciliter les échanges. La raison d’être et les exigences relatives à la certification des exportations devront être communiquées de manière transparente et systématiquement mises en œuvre de manière non discriminatoire. Les certificats devront être conçus et utilisés de sorte à:

PRESENTATION STANDARD
7. Les certificats devront contenir une déclaration de l’organisme de certification officiel ou officiellement agréé et être dûment signés et cachetés par un agent autorisé à cet effet par l’autorité compétente. Le certificat devra clairement identifier l’organisme de certification grâce à un papier à entête et/ou un logo.
8. Chaque certificat officiel devra porter un numéro d’identification unique et être imprimé dans un style dénué d’ambiguïté dans une ou plusieurs langues parfaitement comprise(s) par les agents de certification et l’autorité destinataire. Un registre des numéros d’identification uniques affectés aux lots de certificats imprimés devra être tenu par l’autorité compétente et pouvoir être mis en relation avec les certificats distribués. [Selon les circonstances, il pourra être exigé que les certificats délivrés par les organismes officiellement agréés portent un numéro d’identification unique.]
9. Le certificat original devra être identifiable de manière unique et être imprimé avec au moins une copie destinée à l’autorité de certification qui la conservera pendant une période de temps appropriée. Des exemplaires supplémentaires pourront être des copies ou photocopies officiellement imprimées. Dans tous les cas, le statut du certificat devra être clair, par exemple, en utilisant les marques «original» ou «copie».
10. Les certificats, quel que soit leur format, devront être conçus de sorte à minimiser le risque de fraude (par exemple, en utilisant du papier filigrané, du papier ne pouvant pas être photocopié ou toute autre mesure de sécurité).
11. Lorsque les certificats sont produits sous un format physique, ils devront être présentés sur une feuille de papier ou, lorsque plusieurs pages sont nécessaires, sous une forme telle que chacune des pages fasse partie d’une feuille de papier entière et indivisible. Lorsque cela n’est pas possible, chaque feuille devra être paraphée par l’agent de certification et/ou numérotée de sorte à indiquer qu’elle fait partie d’une séquence finie (par ex. page 2 de 4 pages).
12. Les certificats devront contenir une référence claire à toute exigence spécifiée à laquelle le produit certifié doit se conformer.
13. Le certificat devra clairement décrire le produit et l’expédition auxquels il fait référence de manière unique.

L’usage de moyens électroniques pour délivrer ou transférer des certificats devra être accepté lorsque l’intégrité du système de certification a été garanti à la satisfaction des autorités pertinentes du pays importateur et du pays exportateur. Le certificat sous format papier devra pouvoir être présenté sur demande aux autorités du pays importateur. Lorsque des certificats électroniques sont utilisés, les inspecteurs du pays importateur devront avoir un accès électronique aux détails de la certification.
DETAILS CONCERNANT L’EXPEDITION
(NOTE: Ces détails ne sont pas spécifiques aux aliments et correspondent au champ d’information figurant normalement sur toute lettre de transport international relative aux vaisseaux transportant des produits entre pays. L’inclusion des informations de transport dans les documents officiels de certification permet de vérifier les détails concernant le produit).
16. Les détails du produit certifié devront être clairement documentés sur le certificat qui devra au moins contenir les informations suivantes:

17. Lorsque, dans des cas exceptionnels justifiés par un problème immédiat pour la santé publique, le pays importateur exige une déclaration concernant l’origine des ingrédients d’un produit, le certificat devra spécifier l’origine des ingrédients issus de pays autres que le pays exportateur.
ATTESTATIONS
18. Les attestations devant figurer dans un certificat seront déterminées par les exigences spécifiées du pays importateur. Elles devront être clairement identifiées dans le texte du certificat. De telles attestations pourront, entre autres, inclure:
19. L’autorité de certification devra être désignée et habilitée par la législation ou les règlements nationaux pertinents, de manière convenable et transparente, afin de fournir les attestations particulières requises dans un certificat.
20. Les autorités devront veiller à ce que leurs procédures permettent la délivrance du certificat en temps voulu de sorte à éviter toute perturbation inutile des échanges.
21. Les autorités devront disposer d’un système efficace permettant d’éviter, autant que possible, l’usage frauduleux des certificats officiels.
RESPONSABILITES DES AGENTS DE CERTIFICATION
22. Des informations et des notes d’orientation facilitant la préparation correcte des certificats devront être disponibles à tous les agents de certification ainsi qu’aux parties responsables de fournir des détails devant figurer dans les certificats.

24. L’importateur (le consignataire) devra s’assurer que le produit est présenté aux autorités du pays importateur accompagné du certificat original, en conformité avec les exigences spécifiées du pays importateur.
INSTRUCTIONS SUR LA MANIERE DE REMPLIR LE FORMULAIRE
25. Les originaux des certificats devront toujours être délivrés et présentés à l’exportateur ou à son agent.
26. Une copie du certificat (clairement marquée «COPIE» ou «DUPLICATA») devra être fournie aux autorités compétentes des pays importateurs et exportateurs à la demande de celles-ci.
27. En signant un certificat, l’agent devra s’assurer que:

Lorsque, pour un motif valable (tel que détérioration du certificat
en transit), l’agent de certification délivre un certificat de remplacement,
celui-ci devra être clairement marqué «REMPLACEMENT» avant
