Conflicts

The Voluntary Guidelines advocate that steps should be taken to prevent and eliminate issues of tenure as a cause of conflict and that aspects of tenure are addressed before, during and after conflicts. 

In order that tenure problems do not lead to conflicts, efforts should be made to resolve those problems through peaceful means.

Where conflicts arise, legitimate tenure rights must be protected and respected. When conflicts end, tenure problems should be addressed in ways that support durable solutions.  

Where restitution is possible, refugees and displaced persons should be able to regain their legitimate tenure rights promptly. Where restitution is not possible, the provision of secure access to alternative land, fisheries and forests for refugees and displaced persons should be negotiated with host communities and others to ensure that the resettlement does not jeopardize the livelihoods of others.
