The Constitution of the Republic of Haiti explicitly guarantees the right to adequate food.

The Republic of Haiti has become a State party to the International Covenant on Economic, Social and Cultural Rights (ICESCR) in 2013 by way of accession.

CONSTITUTIONAL RECOGNITIONS OF THE RIGHT TO ADEQUATE FOOD

Explicit protection of the right to adequate food

Article 22: “The State recognizes the right of every citizen to decent housing, education, food and social security.”

National status of international obligations

Article 276. 2: “Once international treaties or agreements are approved and ratified in the manner stipulated by the Constitution, they become part of the legislation of the country and abrogate any laws in conflict with them.”

Other pertinent provisions for the realization of the right to adequate food

Article 19: “The State has the absolute obligation to guarantee the right to life, health, and respect of the human person for all citizens without distinction, in conformity with the Universal Declaration of the Rights of Man.”

Legislation and policies recognizing the right to adequate food

Guidance on how to progressively realise the human right to adequate food in contexts of national food security has been provided by the Right to Food Guidelines, adopted by the FAO Council and endorsed by the Committee on World Food Security.
