General provisions
1. The “Wood Energy Catalogue” (WEC) is an online database and a knowledge-sharing platform developed and administered by Food and Agriculture Organization of the United Nations (FAO), whose purpose is to host information on major initiatives, policies and regulations, programs and/or projects (interventions) in developing countries related to production and consumption of woodfuels, including fuelwood, charcoal, wood pellets, among others, and their social, economic and environmental impacts.
2. The WEC is open to all interested stakeholders, including policy makers, project practitioners, project developers, donor agencies, and researchers. Depending on how to the access the information as provided by the WEC, the users of the WEC include general users and registered users, to whom clear definitions have been provided in the “Definitions”.
3. By registering with the WEC, you acknowledge and accept to be bound by these Terms and Conditions, and the FAO’s Terms and Conditions. In the event of a conflict or inconsistency between these Terms and Conditions and FAO’s Terms and Conditions, the present Terms and Conditions shall prevail to the extent necessary to resolve such conflict or inconsistency.
4. As the administrator of the WEC, FAO has the right to remove from any information which is not in compliance with these Terms and Conditions or any information that FAO thinks is not appropriate.
Definitions
5. The following definitions shall apply to these Terms and Conditions and any other related document:
i) ‘Registered Users’ refer to those users who wish to contribute Content and related information to the database of the WEC are invited to register as subscribers, so as to be able to submit inputs, upload files, and get informed of changes through regular update.
ii) ‘General Users’ refer to those uses who are not required to register as subscribers, but may search the database by country, region, type of interventions, technical intervention, implementing agency, funding source (donor), or keywords, as well as browse the search findings online or download relevant files.
iii) ‘Third Party(ies)’ means any natural or legal person, public authority, agency or any other body other than the registered users or FAO, which may access and process data from the WEC.
iv) ‘Personal Data’ means any information relating to a person who is or can be identified either from the registration form, or from the data in conjunction with other information that is in, or is likely to come into, the possession of FAO. Personal Data may include but is not limited to: (a) name and surname; (b) country; (c) personal contacts (e.g. email address, postal address, telephone number, etc.); (d) the organization or company you are representing or working for; (e) your role in your organization.
v) ‘Processing of data’ means any operation or set of operations which is performed on, or using data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction.
vi) ‘Content’ means any data, information, materials (such as reports, photos, maps, etc.), and external links that registered users provide when accessing or submitting through the WEC.
Uploading of information to the WEC by Registered Users
6. Only registered users can access to upload information and share Content through the WEC.
7. FAO reserves the right to verify your eligibility to use the WEC and the validity of any entry (including your identity and email address). FAO also reserves the right to not publish any information or Content submitted and remove any registered user who submits data that is not in accordance with these Terms and Conditions or who tampers with the entry process. By submitting data to the WEC, you agree that your Personal Data may be processed, shared, and otherwise used for the purposes and within the context of the WEC and any other purposes outlined in these Terms and Conditions.
8. FAO reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the information and Content as provided in the WEC, including any means of accessing or utilizing it, at its sole discretion with or without prior notice to users.
9. FAO may at its sole discretion, under any circumstances, for any or no reason whatsoever and with or without prior notice, terminate your access as registered ser to the WEC, including to any means of accessing or utilizing it.
Responsibility of registered Users
10. As a registered user, you acknowledge and agree that you:
- will comply with all applicable laws, including, without limitation, data protection laws, privacy laws, anti-spam laws, intellectual property laws;
- are responsible for ensuring the integrity and security of the information that you provide when accessing or using the WEC, including any Personal Data; any false or misrepresentative identity, affiliation with a person or entity, past or present, or your current or previous positions and qualifications is not allowed;
- have the appropriate authorization(s) to submit the Content and related information in your organization’s name;
- are responsible for making sure that no Third Party can claim any rights on the Content or other information provided by you;
- cannot publicly represent or imply that FAO is participating in, or has sponsored, approved or endorsed the manner or purpose of your use of the WEC;
- will not knowingly upload or attach files that contain viruses, corrupted files that may damage the operation of the WEC or of another computer or delete information;
- will not delete any attributions, legal notices or proprietary designations or labels in any provided information will provide Content and related information to the WEC on the understanding that you assume responsibility for independently assessing its relevance, accuracy, completeness, and suitability for application;
- cannot publicly represent or imply that FAO has sponsored, approved or endorsed the manner or purpose of your use of the WEC.
11. By using the WEC, you further agree that FAO may - in accordance with the scope of the Content and related information- reproduce, distribute, display and create derivate works, in connection with the purpose of the WEC and the promotion of FAO’s objectives, without any further consent, notice and/or compensation to you or others, of the data provided in the WEC including contact details and Personal Data.
12. By accepting these Terms and Conditions, you agree that FAO shall process the data collected and submitted to the WEC and/or Personal Data in accordance with its rules, policies and practice, to the exclusion of any single national system of law.
Intellectual Property Rights and Copyright
13. Intellectual Property Rights, including Copyright, over the Content will remain with the original Copyright holder(s). By submitting the Content and related information to the WEC, you grant an irrevocable, perpetual, worldwide license to FAO, for non-commercial purposes, to reproduce, distribute, display and create derivative works of the Content (along with a name credit) in connection with the WEC and the promotion of FAO’s work, in, amongst others:
- the WEC;
- FAO corporate website: www.fao.org;
- corporate videos or digital recordings to illustrate the work of the Organization;
- printed FAO publications or brochures;
- social media channels;
- any other media used by FAO in its communications.
14. Intellectual Property Rights, including Copyright over the summaries and any other form in which the Content will be presented by FAO in the WEC and any other new materials developed on the basis of the information collected through the WEC shall be vested in FAO.
Disclaimer and Liability
15. While the Content and related information contained in the WEC is periodically updated, no guarantee is given that the Content and information provided is correct, complete, and up to date. The Content and related information available on the WEC is provided as “it is”, FAO makes no, and expressly disclaims any, representations or warranties, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose and non-infringement.
16. Unless expressly stated otherwise, the Content and related information contained in the WEC represents the personal views of the registered users, which do not necessarily reflect the views of or imply the endorsement of FAO. FAO shall not be liable in respect of any such views, irrespective of whether FAO is aware or ought to have been aware of them.
17. Reliance upon any Content or related information from the WEC shall be at the user’s, either register or general Users, own risk. Neither FAO, nor any of its employees, shall be liable to any user or anyone else for any misrepresentation, inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any Content herein, or for its timeliness or completeness.
18. The designations employed and the presentation of the Content and related information in the WEC do not imply the expression of any opinion whatsoever on the part of FAO concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries.
19. In accordance with these Terms and Conditions, FAO will not seek additional approvals in connection with the use of the Content and related information and it will not be not be liable for any inaccurate information as uploaded by a Third Party, nor it will be responsible for any claim or complaint alleging violation of the rights of a Third Party.
20. FAO makes no, and expressly disclaims any, warranties, express or implied, regarding the correctness, accuracy, completeness, timeliness, and reliability of the text, graphics, links to other sites and any other items accessed from or via the WEC , or that the services will be uninterrupted, error-free or free of viruses or other harmful components.
21. Under no circumstances shall FAO, its authorized vendors and/or subcontractors, or any of their respective partners, officers, directors, employees, agents or representatives be liable for any loss or damage arising from, or directly or indirectly connected to, the use of, reference to, or reliance on the Content and related information contained in the WEC , including, but not limited to, any liability arising from any intentional or negligent misuse, errors, disclosure, undue transfer, loss or destruction of information that may occur.
22. FAO shall not be responsible for any entries that is not received due to internet connection or software failures.
23. As a condition of use of the WEC, the user agrees to indemnify FAO and its employees from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of his/her/its use of the WEC, including, without limitation, any claims alleging facts that if true would constitute a breach by the user of these Terms and Conditions. If the user is dissatisfied with any Content or information on the WEC or with any of these Terms and Conditions, the user’s sole and exclusive remedy is to discontinue using the WEC.

Privileges and Immunities
25. Nothing contained in or related to these Terms and Conditions shall be deemed a waiver, express or implied, of the privileges and immunities of FAO, or as its acceptance of the jurisdiction of the courts of any country or of the applicability of any single national system of law over disputes arising out of these Terms and Conditions or documents related thereto.
Acceptance
26. By registering in the WEC, you confirm that you read, understood and agree to these Terms and Conditions and any documents related thereto, as set out above.
