General requirements for import

General Health Law No 26842: Provides general requirements for food imports, sets sanitary standards and provides guidance on the inspection of imported food. The General Health Law establishes that the import, manufacture, trade, distribution or storage of food and beverage products that have been adulterated, contaminated, altered or declared unfit for human consumption is prohibited and that the import of food and beverage products is forbidden from countries where distribution or consumption of the product due to associated health risks is prohibited.

Supreme Decree No 007 of 1998: Sets general hygiene standards, health conditions and requirements, and other standards related to marketing, preparation, and sale of food for all food imports. The Decree also establishes procedures for imports, regulations for the border inspection as well as and food safety measures and sanctions. It also establishes the conditions, requirements, and procedures for the registration, modification, and cancellation of sanitary registrations for food products and the regulations for the inspection of the activities and services related to the production and distribution of food products. The legal text includes food safety measures and sanctions and food quality and safety standards for food and beverage manufacturers based on the Hazard Analysis and Critical Control Points (HACCP) system.

Legislative Decree No 1 290 of 2016: Aims to establish preventive systems to guarantee food safety, to improve administrative procedures, and to strengthen sanitary surveillance and inspection. It also regulates fisheries and aquaculture products in all phases of production.

Legislative Decree No 1402: Sets general requirements on food safety of fisheries and aquaculture products to guarantee public health. In addition, it strengthens the role of SANIPES (Organismo Nacional de Sanidad Pesquera) as the competent authority for all sanitary and fishing related activities.

Additives, contaminants, antimicrobials and residues

Ministerial Resolution No 057 of 2016: Provides guidance about residues of veterinary drugs and contaminants in fisheries and aquaculture products, their standards and their maximum levels.

Food additives: the importation of goods only with the additives established by the Codex Alimentarius is allowed. All others are forbidden and cannot be kept within food and beverage product manufacturing facilities. You can find the list at the following link:

Microbiological and organic criteria

Ministerial Resolution No 057 of 2016: Provides guidance about the microbiological maximum limits in fisheries and aquaculture products of aquatic animal origin.

Labelling and packaging

Supreme Decree No 007 of 1998: Provides general guidance about labelling and packaging requirements.

INDECOPI’s Peruvian Technical Standards NTP 209.038 of 2009: Provides guidance about the necessary requirements and standards for labelling and packaging. The information should include the following information:

a)      The name of the product

b)      Country of origin.

c)      Food additives and ingredients and instructions for use

d)      Name and address of the manufacturer and importer

e)      Sanitary registration number

f)       Expiration Date

g)      Net weight or volume of the product

h)      Production lot code and special conservation conditions (if any)

Traceability

Supreme Decree No 007 of 1998: Provides guidance about hygiene control for imported food and establishes a system of responsibility for recall, in terms of both specific measures and procedures of reporting to the relevant administrative organs. This system allows all importers to recall specific products and outlines a traceability system for all seafood products.

Legislative resolution No 30591: Aims at combating Illegal, Unreported and Unregulated (IUU) fishing, thereby promoting the sustainability of global fisheries.
