Tool for designing, monitoring and evaluating Land Administration Programmes in Latin America

Module 3
LAPs and Subnational Entities

It corresponds to the level of intervention of subnational entities, i.e. Municipal Districts and Indigenous Communities and Territories (ICT) where LAPs seek to promote multipurpose land administration systems.

Intervention levels

This guide contains 5 modules, which allow users to proceed independently of the tool’s own logic. The modules contain numerous external hyperlinks to access a bank of technical documents of the FAO, World Bank and other additional information sources. They also contain internal hyperlinks for navigating between modules or for easy access to the tool’s glossary.

Analysis in terms of municipal governance

In parallel with the evaluation of LAPs, the results and impacts of these programmes as regards the appropriateness of land administration systems and derived impacts can help to strengthen local governance. Based on the UN-Habitat proposal, a proposal has been developed for analysis of local governance in relation to the various indicators in the results grid.

VARIABLES FOR EVALUATING THE EFFECTS OF LAPs IN THIS RESPECT

1) Sustainability
  • Improvement in municipal receipts.
  • Improvement in investment in social services.
  • Improvement in environmental planning.
  • Improvement in investment for sewage water management.
  • Improvement in investment for environmental management plans.

2) Subsidiarity
  • The titling of municipal land in favour of men, women and indigenous communities is carried out through the municipality.
  • Increased investment in municipal capacity building.
  • Increased investment in municipal infrastructure or development by increased collection of property taxes.

3) Fair access
  • More women titled via the municipal route.
  • Indigenous communities located on municipal land can access collective titling programmes.
  • Increased participation of women in information processes on cadastral and registration processes.
  • Increased participation of women in municipal land administration teams.

4) Efficiency
  • Rapid services for cadastral updating and tax payment.
  • Annual income-expenditure report.
  • Increased delivery for improving municipal cadastral units.

5) Transparency and accountability
  • Perception that the property tax is correctly used.
  • Titling processes and costs are known to all citizens..

6) Civic commitment and exercise of citizenship
  • Territorial planning is validated by citizens.
  • The participation of population sectors that are usually marginalized has been strengthened (women, indigenous peoples, young people, etc.).
  • Tenure regularization processes related to the presence of communities are carried out under conditions of free, previous, informed consultation.
  • The definition of municipal boundaries allows people to register in municipal districts where they can exercise their civic rights.

7) Security
  • Strengthening of local dispute resolution mechanisms.
  • A larger number of households and communities have security and legal certainty of tenure.
  • Reduction in disputes over municipal boundaries.
  • Reduction in disputes between people in possession of municipal ejidos.
  • Identification of risk areas.
  • Strengthening of security and legal certainty of tenure rights.
